Nazima is a qualified advocate of the High Court of Kenya with 20 years of practicing experience. She has been a partner at Kaplan & Stratton since 2002. She is also an associate with the Institute of Chartered Arbitrators, a member of the International Bar Association, a registered patent agent, an associate member of the Chartered Institute of Arbitrators (Kenya Chapter) and a member of Commonwealth Lawyers Association.
Nazima’s main area of practice is civil litigation specialising in: tax disputes, intellectual property disputes, debt collection, judicial review matters, banking law and arbitration. Nazima handles matters in the Court of Appeal, the High Court and specialist tribunals.
Nazima has been instructed on several landmark Kenyan decisions including: a matter where she successfully obtained a decision from the High Court which sets out the parameters within which the Kenya Revenue Authority can demand payment of withholding tax; representing Barclays Bank against the Commissioner of Domestic Taxes on a withholding tax claim. The issue in dispute was whether payments to credit card companies were in respect of services and therefore subject to withholding tax; successfully represented Delta Airlines Inc in an application for injunction against Delta Connection stopping them from infringing the “DELTA” mark. The ruling is one of the few by a Kenyan Court making a determination on protection given to internationally renowned trademarks.
