Galadari has been a long-standing and contributing law firm across the Emirates, giving back to its community.  Notably, we are one of only five law firms to have collaborated with the Government of Dubai Legal Affairs (GLAD), where we have created, developed and delivered a continuing professional legal development course (CPD).

In our ongoing effort to continue developing the skills of the wider business community, our clients and the future generation of the Emirates, we deliver regular CPD seminars, share insights and deliver sessions through our lawyers on subjects which include: Civil Law, Corporate and Commercial, Finance, Intellectual Property, Insurance, Employment, Construction, and Real Estate.

As part of our commitment to Emiratisation, the firm provides internships and training contracts for young Emirati law students and new graduates.  This aids them in gaining valuable on-the-job experience by shadowing an experienced lawyer and fulfilling requirements to qualify with the Ministry of Justice and obtain a federal lawyer’s license.  As a result of this effort over 30 Emirati lawyers have opened their own offices and now provide ongoing impact to the country.

As a socially responsible firm, we are proud to be members of the Green Building Council (EmiratesGBC), which is a unique independent forum that works towards promoting and creating green building policies and regulations throughout the UAE.

We are currently committed to providing 1,000 hours of pro bono service to the wider legal community through the Dubai Legal Affairs Department (DLAD) worth AED 1.8m, as well as free training seminars and presentations to clients as part of our value-added services.  Furthermore, we were proud participants of the ‘Goods Will Initiative’ campaign and were recognised by the Dubai courts.

What has been your greatest achievement, in a professional and personal capability?

AZG: My greatest achievement has been becoming a Senior Partner at a young age while balancing a healthy family life, at one of the oldest and largest full-service regional firms in the GCC. Under my leadership, the firm has elevated its position and now competes with international firms, which is a rare accomplishment for an institutional UAE family-owned and managed firm. Mr. Ziad Galadari, Chairman and Founder, has set a legacy plan to maintain our status and continue our growth into the next generation.

Ahmed: As the Head of Litigation of the GCC’s largest multidisciplinary litigation practice, I have always placed a strong focus on the law and strived to deliver the best results for all my clients. During my 32-year career, this has been my biggest challenge and greatest achievement, and I remain dedicated to providing the best possible legal representation.

Can you give me a practical example of how to help a client add value to the business?

Ahmed: An example of adding value to a client’s business which I do regularly would be identifying and addressing unrelated issues which may have a negative impact on their business. This includes providing advice on correcting mistakes and inefficiencies, helping to ultimately improve the overall performance and success of the business.

Within your sector, what do you think will be the biggest challenge for clients over the next 12 months?

AZG: In the legal sector, the biggest challenge for clients over the next 12 months will be navigating the implementation of technology within their respective practices. With an emphasis on cost consciousness due to the current global economic climate, clients must ensure they utilize technology to maintain their competitive edge in an economy prioritizing cost-effectiveness.

Ahmed: Remaining up to date with the constant changes in the legal sector, and monitoring developments on a global scale are necessary to ensure they remain up to date and competitive in this market.

The UAE has implemented a major initiative to update its laws and procedures, by adopting best international practice to encourage foreign direct investment and trade more generally with the UAE. There was a new Companies Law in 2015, a Bankruptcy Law in 2016, tax laws in 2017, and a Federal Arbitration Law and Foreign Direct Investment Law in 2018. In addition to that, Federal law No. 18 of 2017 amended the Companies Law to allow the authorities to dis-apply the requirement for 51% local ownership of UAE companies. A clear message is being sent to the world that the UAE is open for business, there is a strong modern structure in place in a form which is familiar to the big international players and which will serve their business needs.


Are Security Cheques Still an Effective Form of Security in Dubai?

Arbitration in The UAE Under the New Arbitration Law

Arbitration practice and procedure has developed rapidly in the UAE, and the courts now take a far more pro-active role in supporting the arbitration process and enforcing arbitral awards. Strength in numbers – How class actions enable individual voices to be heard.

You made an investment in a publicly listed company based on their information, only to later learn it was misleading, or you purchased a product only to later discover it was harmful. In both cases, your loss might be less or more severe in either situation. If several people have experienced a comparable loss, it could be reasonable for them to combine their claims, so the total amount is significant enough to warrant a lawsuit. This is called a ‘class action’ lawsuit, represented by a group of people with related legal claims against one or more defendants such as investors, patients, consumers, or workers. Currently, the United Arab Emirates does not adopt a precise legal framework for class action lawsuits. This is because the legal system of UAE is based on the civil law system, which differs from the common law system where class actions are more frequent.

What Remedies Does a Buyer Have for Defective Goods Under UAE Law and English Law?

This difficulty is not always apparent in negotiating the contract but becomes apparent when there is a dispute in which the parties argue that the terms in question hold different meanings.
