Position

Adam specialises in insolvency and restructuring. He has had substantial experience of bank and fund insolvencies, acting in relation to the insolvencies of Lehman Brothers, MF Global and Madoff feeder funds. Contested restructurings on which Adam has acted include IMO Car Wash, The Co-Operative Bank, Apcoa Holdings and LDK Solar. Adam also has a substantial banking and financial services practice. He has acted on a number of inter-bank misrepresentation cases including in relation to securitisations, syndicated loans and derivatives. He regularly advises in relation to regulatory matters including in relation to the treatment of client money.

Career

Adam is called to the bar in England and Wales (2007) and in the British Virgin Islands (2011). He has appeared before the Dubai World Tribunal (2013) and he has been admitted in the Cayman Islands for special cases (2014).

Felicity Toube KC acted for the claimants in NMC Healthcare v Dubai Islamic Bank, a significant litigation in Abu Dhabi arising out of the administration of the UAE-based private healthcare group following the discovery of a multi-billion-pound fraud within the business. Adam Al-Attar KC, newly appointed to silk in March 2024, is instructed by SoftBank Vision II Fund to defend a claim by a Credit Suisse sub-fund alleging SoftBank engineered a financial restructuring of construction company Katerra that favoured the Japanese conglomerate over the Swiss bank’s clients. Meanwhile, Tom Smith KC acted for PwC as liquidators of the Abraaj Group, which collapsed in July 2018 following allegations of misuse of funds, leading to the liquidators bringing claims in the Cayman Islands to recover assets transferred from the Abraaj Group prior to its liquidation.
