Chile > Dispute resolution: arbitration
(Leading partners)Fielding ‘a very professional team in which a commercial mentality predominates’, Carey‘s large, 34-strong arbitration practice (including five partners) has extensive experience under a range of local and international institutions, such as the Arbitration Centre of the Santiago Chamber of Commerce (CAM Santiago), International Chamber of Commerce (ICC), and International Centre for Settlement of Investment Disputes (ICSID). It also acts under United Nation Commission on International Trade Law (UNCITRAL) rules. Among the group’s several highly-rated practitioners, Juan Carlos Riesco is a national and international arbitration expert, who is ‘actively involved in all the firm’s arbitration proceedings’; Ricardo Reveco represents both domestic and foreign companies in corporate conflict-related commercial arbitrations; and domestic and international commercial and investment arbitration specialist Aldo Molinari acts for clients from the construction, insurance, aquaculture and energy sectors. The team further showcases Mónica Pérez, whose arbitration practice also encompasses pre-litigious advice to mining, insurance, energy, automotive and retail clients; and Roberto Villaseca, whose recent experience includes representing an insurance company in an insurance coverage-related arbitration dispute. Former practice co-head Gonzalo Fernández left the firm in June 2024 to dedicate himself to his role as an arbitrator; senior associate Arturo Fontecilla is no longer at the firm.
Chile > Dispute resolution: litigation
Carey‘s very sizeable, 36-strong, litigation practice is ‘without a doubt one of the best in Chile’, according to one client. The full-service legal giant has built a strong reputation both nationally and internationally for its consistent involvement in bet-the-company civil and commercial disputes, including matters before the Chilean Supreme Court. It is particularly experienced in financial disputes, including matters comprising fraud allegations and financial scandals. The team further stands out for its expertise in defence-side work for major health institutions, as well as disputes involving public-private contractual relationships. Among the firm’s several experienced practitioners, Aldo Molinari is an experienced civil, commercial, and administrative litigator; Juan Carlos Riesco ‘applies his knowledge in a wonderful way’; and Ricardo Reveco focuses on civil and commercial litigation, along with arbitration, bankruptcy and insolvency work. The next line of experienced litigators includes Mónica Pérez (‘the support she gives in complex cases is simply extraordinary’), who litigates retail, mining, insurance, energy and automotive sector disputes; and litigation and ADR practitioner Roberto Villaseca, who acts before both Chile’s ordinary and special litigation courts, and whose caseload encompasses international trade disputes, as well as bankruptcy and insolvency issues. At associate level, key support is provided by senior Mirko Villarroel. Former practice co-head Gonzalo Fernández left to establish his own boutique and focus on his role as an arbitrator in June 2024, taking Arturo Fontecilla with him.
