Corporate investigations often do not stay in one place. Regulators, prosecutors and enforcement bodies in Spain, the EU and other jurisdictions are increasingly involved at the same time.
As regulatory expectations continue to expand, legal departments are also taking on a broader role in risk management and corporate governance. General counsel are increasingly expected not only to respond to investigations, but also to identify potential risks, advise senior leadership, and help shape their organisation’s approach to compliance and accountability.
This panel will look at the practical issues that come up in cross-border investigations, including parallel proceedings, coordination between authorities, and dealing with evidence and data across different legal systems. It will also look at how general counsel approach strategy when more than one regulator is involved, balancing commercial priorities with growing expectations around regulatory oversight.
The discussion will focus on what this means in practice for in-house teams: running investigations across jurisdictions, dealing with disclosure and privilege issues, and working with regulators and external advisers in different countries. Panellists will also consider how investigations are reshaping the role of legal departments, requiring GCs to act both as strategic advisers to the business and as guardians of corporate integrity.

For many Spanish in-house teams, arbitration has become increasingly complex to manage in the last few years. Regulatory changes, pressure on legal budgets, the growing role of third-party funders, and higher expectations from the business have all raised the stakes. Arbitration can still be the right tool when handling disputes from a commercial perspective, but it now requires much closer attention and closer management than before.
For general counsel, choosing arbitration is no longer a purely legal decision, but a business strategy. It is often a commitment to a long and resource-intensive process that needs to be explained internally, monitored closely and continuously adjusted as the dispute evolves. What looks sensible at the clause-drafting stage does not always play out as expected once the dispute is underway.
This panel will bring together GCs and arbitration practitioners to discuss how arbitration is actually being managed inside companies today. The conversation will focus on recent cases and real decisions regarding how costs have been managed (or not), how strategy evolves mid-proceeding, where surprises have caught teams off guard, and how legal teams can better anticipate and manage arbitration processes in practice.
