- Advising Dudley Group NHS Foundation Trust on a complex claim linked to a CQC prosecution involving emotive issues as well pure clinical analysis. The defendant did not admit the poor management in ED caused the death as the evidence suggested the sepsis was established on presentation to ED. Nevertheless, there was a desire by both parties to resolve the claim without formal civil proceedings. Settlement £900,000.
- Advising Birmingham Women’s and Children’s Hospital NHS FT in a case where a 75% discount was secured following forensic review of the literature dating back to 2007 – 2013 regarding a newly recognised genetic condition. The condition and lack of treatment caused the claimant’s stroke at age 6. The defendant demonstrated the condition was not well known, nor were there established practices for diagnosis or treatment at the time. Settlement £3.75m.
- Advising Maidstone and Tunbridge Wells NHS Trust where liability was disputed in litigation associated with birth injury (brain damage): secured 15% liability risk discount. Quantification by 10 experts per party during the pandemic to resolve by negotiation: agreeing lump sum and PPO settlement in the region of £17m.
- Acted on behalf of Zurich Insurance and its local authority insured who had a significant financial interest in this claim. The claimant alleged he developed functional neurological disorder because of being assaulted at a residential care home whilst working there as a care worker. The defendant could find no record of the incident which they said could not therefore have happened. Following the exchange of evidence, the claimant sought to discontinue the claim.
- Advising MMI Insurance / Humberside Police in a case whereby the claimant was employed by the police force since the age of 16 and during her employment with them she alleged exposure to asbestos within the basement where she would access custody files. The claimant was diagnosed with mesothelioma (an incurable cancer caused by asbestos exposure) at the age of 48. The claim was valued at more than £1.5m. A forensic analysis of the claimant’s promotion prospects, pension and lump sum payments was undertaken by the handler, significantly reducing the value of the claim.
