Clarke Energy also entered into a long-term contract to maintain the facility for Alinta Energy following completion of the EPC works.

Drafting and negotiating contracts for mixed use projects in Queensland, Victoria and South Australia, including the Whitehorse Towers development in Box Hill which comprises two towers, 511 apartments, restaurant and retail space and a 5-star Art Series hotel and the commercial development at 101 Moray Street, South Melbourne.

Advising in relation to the $2.28 bn SA-NSW electricity interconnector project known as Project EnergyConnect.​

Probuild

Acting successfully for Probuild in the seminal Victorian Supreme Court decision of V601 v Probuild Constructions [2021] VSC 849 – a dispute in relation to the design and construction of a mixed use development in Abbotsform. The proceeding traversed complex issues in relation to the independence of the Superintendent, delay methodologies and whether contractors can recover acceleration costs where the Superintendent refuses to grant an extension of time.

Acting in relation to the proposed Summerfield Renewable Energy Hub in South Australia capable of hosting over 1.2GW across a range of generation technologies including Solar, BESS, CCGT and Hydrogen.

Advising the state Government on the $9.9B Torrens to Darlington motorway project. Involves environmental and land use considerations unique to the project.

South Australian Department of Treasury and Finance

Acted for the South Australian Government in relation to its planned $13 billion hydrogen hub at Port Bonython. The partners which have been publicly announced for the site, which may host up to 3GW of hydrogen electrolysers by 2030, include Fortescue Future Industries, Origin Energy, Santos and H2U, along with international companies such as Eneos, Chiyoda, Mitsubishi and AMP Energy.

Acting for Sugar Australia in relation to the design and construction of a sugar refinery in Victoria, including claims for defective / incomplete work and damages, defending claims for extensions of time and delay costs and entitlement under security of payment legislation. These disputes culminated in the reported decisions of Sugar Australia Limited v Conneq [2011] NSWSC 805, Sugar Australia Pty Ltd v Southern Ocean Pty Ltd & Anor [2013] VSC 535 and Sugar Australia Pty Ltd v Lend Lease Services Pty Ltd [2015] VSCA 98.

Vaughan Constructions

Acting for Vaughan Constructions in respect of various Supreme Court and VCAT proceedings relating to the alleged subsidence of a warehouse building in Epping, Victoria. This is a complex case involving an array of technical expert evidence regarding (amongst other things) causation of the subsidence and the proper quantification of rectification costs.

Acting for Ventia (then Thiess Services / Silcar) in a dispute with an Australian government owned corporation involving complex and substantial claims for payment in excess of AU$150m associated with the rollout of a nationwide upgrade to telecommunications infrastructure.

Acting for Watpac on a range of contentious claims in Victoria and South Australia, including claims arising out of the construction of the Kodo and Mayfair Hotels in Adelaide, South Australia, as well as claims for unpaid monies and the return of bank guarantees made by the liquidators of the Hastie Group (see the recent decision of Hastie Group Limited (in liq) v Multiplex Constructions Pty Ltd (Formerly Brookfield Multiplex Constructions Pty Ltd) (No 3) [2022] FCA 1280).

Advising Watpac on the contract awarded by Australian Unity for construction of the Specialist Ambulatory Care Centre and Stages 1 to 3 of the Herston Quarter redevelopment.

WBHO and SNC-Lavalin JV

Acting in a dispute with the EPC Contractor concerning substantial claims for time and money and counterclaims for liquidated damages associated with the design and construction of the Stockyard Hill Windfarm – at the time the largest wind farm in the Southern hemisphere. This included a successful application for adjudication against the EPC Contractor.
