An Italian-Spanish platform active in the energy transition sector with a pipeline of approximately 2GW projects under development, and a developer with extensive experience in the reference sector with approximately 1 GW ongoing developments, signed a contractual joint venture to develop utility scale photovoltaic plants. Lexia assisted MR Wind in negotiating and finalizing the JV documentation.

LEXIA assisted a leading international investment fund operator focused on renewable energy, energy transition and sustainable infrastructure – and a company active in the development of renewable energy plants – in the establishment of a 50:50 joint venture to develop renewable energy plants in Italy with a maximum capacity of 1GW.

The new Lazio Region Resolution for the installation of RES plants

The Lazio Region with Resolution no. 171 of May 12th, 2023 provided guidelines and transitional criteria for the development of renewable energy sources concerning the issue of the single regional authorisation measure pursuant to Article 27-bis of Legislative Decree no. 152 of April 3rd, 2006 (Norme in materia ambientale), concerning the construction of ground-mounted photovoltaic and wind power plants on regional territory.

The new amendment to Article 47 of Decree Law no. 13/2023 excludes environmental procedures

Article 6 of EU Council Regulation no. 2022/2577 of December 22nd, 2022 provides the possibility for European States to exempt from environmental assessments renewable energy projects, energy storage projects, and electricity grid projects located in areas dedicated to renewable energy or the grid, which have already undergone a completed Strategic Environmental Assessment (hereinafter “SEA”).

In order to implement the provisions of the aforementioned article 6, the Italian Government submitted an amendment to Decree-Law no. 13 of February 24th, 2023, which came into effect on February 25th, 2023 (hereinafter, “D.L. 13/2023”), which provides the introduction of paragraphs 1-bis, 1-ter and 1-quarter to article 47.

The PNRR 3 Decree and provisions for the renewable energy sector

Law Decree no. 13 of February 24, 2023, entered into force on February 25, 2023, (hereinafter also referred to as the “Decree PNRR 3”) adopted “Urgent provisions for the implementation of the National Recovery and Resilience Plan (NRP) and the National Plan for Complementary Investments to the NRP (NCIP), as well as for the implementation of cohesion policies and the common agricultural policy”.

The Decree PNRR 3 introduced some innovations with regard to:

  • Steering Committe (“Conferenza di servizi”)
  • installation of FER Plants on state-owned assets;
  • technical Commission for EIA procedure and the PNRR-PNIEC Technical Commission
  • provisions on EIA procedure;
  • measures on renewable green hydrogen;
  • suitable areas for renewables energy plants (“FER plants”);
  • simplified authorization procedure;
  • provisions on energy communities (“CERs“).
