Acting in a $200m class action against a number of AMP Limited financial ladvice licensees in which it is claimed that the respondents received conflicted dremuneration (including commissions), recommended certain insurance products which attracted excess premiums, and failed to provide any or adequate personal advice with respect to certain financial land insurance products.

Bogasi Pty Ltd Representing a trustee company (Bogasi Pty Ltd)

In relation to proceedings concerning the beneficial l
ownership of significant trust assets. The claim relates, amongst other things, to the construction of a Will of the late patriarch of the Sundell family. The assets in dispute are in the order of more than $50 million.

Acting in a class action against former CBA subsidiary, Count Financial Ltd (Count), in respect of allegations that Count and its financial ladvisers contravened best interests and priority obligations owed to customers when taking grandfathered commissions on products that they recommended to their customers.

Dixon Advisory Class Action (Balance Legal Capital)

Acts for Kosen-rufu Pty Ltd an investor in financial products recommended by the now insolvent Dixon Advisory Superannuation Services. The class action is regulated as an MIS in accordance with recent changes to the class action regulation in Australia and is funded by UK litigation funder Balance Legal Capital. The class action is against ASX listed entity, E&P Financial Group Ltd and its subsidiary for breach of best interests and client priority duties arising from the receipt of conflicted remuneration when providing personal financial advice to clients. The claim follows ASIC civil penalty proceedings currently on foot in respect of the same conduct.

Peregrine Corporation

Currently defending an employment class action on behalf of Shahin Enterprises Pty Ltd, a company within the Peregrine Corporation. The Applicant law firm has alleged losses of up to AU$70 million. Peregrine is one of the top 15 private companies in Australia and the largest private company and employer in South Australia. The class action is a novel proceeding and involves five group claims covering thousands of employees. The action is factually complex given the diverse circumstances and characteristics of each group member and their differing employment relationships with their employer.

Acting for Zoetis Australia defending a $53 million class action brought by the owners of horses which were administered with the Hendra Virus vaccine developed by Zoetis, who allege the horses suffered side effects from the vaccine.

Filed a class action in the Federal Court of Australia on behalf shareholders against publicly listed utilities company Downer EDI Limited (Downer) alleging that Downer was in breach of its continuous disclosure obligations and engaged in misleading and deceptive conduct.

Herbalife Class Action
Piper Alderman is investigating a class action on behalf of thousands of Herbalife Nutrition members in Australia.

The investigation concerns persons who have suffered financial loss as a result of participating in the ‘business opportunity’ model promoted by Herbalife Nutrition, with the class action alleging that this model is a ‘pyramid scheme’ or is otherwise promoted using misleading representations. If established, such conduct is a breach of the Australian Consumer Law.

Working with an international litigation funder to investigate a class action against Mercedes-Benz Australia/Pacific Pty Ltd (Mercedes Australia) and Mercedes-Benz Group (Mercedes Group), on behalf of people who purchased a Mercedes-Benz diesel vehicle from 2008 to 2019 that were fitted with “defeat devices”.

Qantas Flight Credits Class Action

Filed a Class Action in the Federal Court of Australia against Qantas Airways Limited (Qantas) on behalf of customers who purchased a ticket from Qantas during the period March 2020 to December 2021 (Relevant Period) and were subsequently issued one or more ‘flight credits’ following either a cancellation of their Qantas flight or self cancellation having been induced by Qantas to do same.
