Career

Standing out as a high-profile professional with more than 15 years of experience in dispute resolution. He is a recognized expert in advising on complex international commercial arbitration, investment arbitration and domestic arbitration disputes.

His track record includes participation in investment arbitrations before ICSID and international commercial arbitrations under the Arbitration Rules of the United Nations Commission on International Trade Law (UNCITRAL), before the International Court of Arbitration of the International Chamber of Commerce (ICC), before the Inter-American Commercial Arbitration Commission (CIAC) and before the International Chamber of Arbitration of Paris (CAIP).

His experience covers various sectors, with emphasis on construction, energy, hydrocarbons, infrastructure and telecommunications, representing public and private companies. In addition, he has experience in public international law and acts as arbitrator in the main arbitration centers in the country, having acted as sole arbitrator, co-arbitrator and President of the Arbitral Tribunal.

Prior to joining CMS Grau, Javier held the position of Senior Associate of the Regulatory and International Arbitration Area at Estudio Echecopar associated with Baker & McKenzie International. Previously, he was part of the international arbitration team at White & Case LLP in Washington, D.C., participating in arbitrations before the ICSID and international commercial arbitrations.

Javier has an outstanding academic background, including an LL.M. in International Legal Studies from American University Washington College of Law and specialized courses in national and international arbitration, concessions and corporate law. In addition, he is a lecturer in the Master of Business Law at Universidad de Lima, where he teaches the course “International Trade and Investment Protection”. Javier is a frequent speaker at national and international seminars and has written articles on arbitration in renowned national and foreign legal journals. He is a member of the Rising Arbitrators Initiative, of the Arbitration Commission of the ICC Peru National Committee, as well as member and Country Rapporteur for Peru of the ICC International Court of Arbitration Task Force on the New York Convention on the Recognition and Enforcement of Foreign Arbitral Awards.

Situated within a global network, the arbitration department at CMS Grau handles both domestic and international arbitration proceedings, primarily relating to commercial issues, contracts and investment issues, often before the ICC and ICSID. The team is skilled in designing strategies for conflict prevention purposes. The group is led by Luis Alberto Linan, who is experienced in representing telecoms and mining companies in civil and constitutional proceedings; Javier Ferrero, who handles complex investment arbitration cases; and Michelle Barclay, who focuses on advising companies in relation to infrastructure and PPP projects. Carlos Hamann specialises in energy and natural resources disputes, while Ramon Huapaya’s scope of work covers public procurement and government contract-related arbitration.

Offering an interdisciplinary service through its cooperation with the firm’s other departments, the litigation team at CMS Grau advises clients from the insurance, tech and electricity industries. Civil and administrative proceedings and civil, constitutional and commercial litigation are all core workflows for the group.
