Position

Martín is the managing partner of Guerrero Olivos and a member of the real estate area. In addition, he is a member of the environment department.

Career

He specializes in project development, construction, real estate regulatory and permitting, acquisition and sale of real estate projects and AAA Class buildings, environmental regulatory and transactional matters, and environmental disputes.  His real estate practice has both a transactional and a regulatory focus. In the regulatory area, Martín has become one of the most prominent experts in Chile in zoning regulations and real estate permits conflicts.

Martín served as Adviser and Chief of Staff to the Minister of Housing and Urban Planning of Chile (1997-2000) and was CEO of the Chilean environmental consultancy firm Sustentable S.A. (2002-2006).

He is a member of the Legislation Committee of the Chilean Chamber of Construction. Currently, Martín is President of the board of the Vivienda and Techo-Chile Foundation, Director of Déficit Cero, and a board member of the Moreau Foundation. In the academic field, he is Co-Director of the Real Estate Law and Business Diploma at the School of Law of the Universidad Católica de Chile and has served as a Professor in the Urban Planning Master’s program at the Architecture School of the same university

Education

He graduated from the Pontificia Universidad Católica de Chile School of Law (1995). He has a Master of Laws (LLM) and a Master in Public Policy (MPP) from the University of Michigan (2002).

Consisting of ‘good partners and associates that are capable of resolving complex issues’, Guerrero Olivos‘ seven-member real estate team is consistently mandated by major developers, construction companies, investment funds and asset managers. It has notable industry expertise in retail, mining, and food and drink; and representative experience for the group includes significant real estate transactions, financings and leasings, as well as real estate asset management and project development. The full-service practice also assists with a wide range of regulatory and permitting issues, in addition to real estate litigation; and its assistance on real estate projects includes letters of intent for site acquisitions, construction contracts and the eventual sales of units. The department is led by firm managing partner Martín Santa María, who specialises in project development, construction, real estate regulatory work, and the acquisition and sale of real estate projects. In a boost to the practice, real estate law expert Tomás Rosemary, an adviser on site transactions, project acquisitions, title reports, real estate financing, leasing contracts, and real estate litigation, was promoted to partner in January 2024. At senior associate level, Macarena Montt‘s real estate workload encompasses due diligence processes, real estate developments, construction and developers’ day-to-day matters.

The 13-strong team at full-service firm Guerrero Olivos is consistently mandated to advise on a broad range of environment matters. The practice group’s expertise encompasses environmental litigation, regulatory compliance, and the environmental aspects of energy, mining, real estate and construction project development. It is also sought out to assist with M&A-related environmental due diligence. The team is particularly active on behalf of energy and mining companies, real estate developers, ports and terminal operators, as well as waste management, logistics, manufacturing, and food and drink businesses. Also of note, the group acts for non-governmental conservation organisations, along with investors and start-up companies that focus on environmental sustainability. The department showcases four partners, namely: Clemente Pérez, an expert in environmental litigation, the environmental aspects of international M&A, regulatory work, and the environmental implications of real estate and energy project developments; Martín Santa María, who specialises in environmental assessments and urban planning; Sebastián Abogabir, an adviser on non-conventional energy project-related environmental assessments; and Benjamín Pérez, who is experienced in mining project-related environmental issues. In the firm’s associate ranks, senior Francisca Pellegrini routinely advises on the environmental aspects of energy projects; and Sebastián Mozó is another key member of the mining, water law and environmental law teams. Since publication, Pellegrini has been raised to the partnership – effective as fo February 2025.
