Position
Crispin is a contentious insolvency specialist with extensive experience of complex domestic and cross border restructuring situations, enforcements and formal insolvency processes with a particular focus on insolvency litigation, litigation funding and recovery.
He provides advice to a broad range of clients in all aspects of contentious insolvency and restructuring, both in and out of court. Typical mandates include:
• contingency planning for companies and directors in the zone of insolvency, contesting insolvency proceedings and defence of misconduct and antecedent transaction claims;
• acting for insolvency office holders to plan and execute restructuring strategies across any relevant jurisdictions, including conducting or defending any related claims, recognition and relief applications and support for ongoing trading;
• acting for creditors and creditor groups to maximise recoveries through strategic participation in an enforcement/restructuring process or contesting/ disrupting such process;
• acting for third parties interested in acquiring assets or claims from distressed or insolvency situations.
A significant part of Crispin’s practice has included sourcing and obtaining funding / AE insurance for claims on behalf of insolvency office holders and acting for both dedicated and one-off litigation funders.
Having represented such a varied client base (rather than focusing on e.g. creditors/ debtors) in respect of a such a wide range of insolvent or near insolvent situations he has valuable insight into the options available to any client as well as the likely courses of action of any opponent.
