Career
Valentin Berea is a Partner of RTPR (Radu Tărăcilă Pădurari Retevoescu SCA). He specialises in disputes and investigations, with a focus on antitrust and intellectual property.
Valentin is included on the list of arbitrators of the Bucharest International Arbitration Court attached to the American Chamber of Commerce in Romania (AmCham) and is a member of the Administrative Council of this court.
He is also a certified intellectual property counsellor for trademarks and industrial designs and has worked for many years as an assistant professor teaching contract law at Bucharest Law University.
Who’s Who of Competition Lawyers has included Valentin for the last 10 years among the list of top 10 competition law specialists in Romania, a list that is prepared exclusively based on peers’ feedback.
Among recent highlights, Valentin has successfully represented Electrica in a EUR 800 million litigation case against the Romanian Management Company for Ownership in Energy (SAPE) for alleged breaches of the post-privatisation monitoring obligations regarding former distribution subsidiaries of Electrica. He successfully represented the most important Hollywood studios, including Paramount, Sony, Twentieth, Universal, Walt Disney, Columbia and Warner Bros. in the first site blocking case which has ever been tried in Central and Eastern Europe, by suing internet service providers with the aim of blocking pirate movies websites. In anti-trust litigation, Valentin has distinguished himself by winning some of the most notable antitrust litigation cases. For example, together with his team, he succeeded in obtaining in court the first significant reduction (of over 80%) of a fine imposed by the Competition Council (on the insulin trading market), based on a mitigating circumstance. This has set a precedent in court of reducing the fines imposed by the competition authority. Recently, Valentin obtained the full exoneration of British American Tobacco after representing the company in a cartel investigation which lasted for 4 years (including dawn raid proceedings).
