Work Department
Senior Associate in the Commercial Disputes and Investigations Group and the ESG Advisory Group
Position
Emma is a senior associate in the Commercial Disputes and Investigations Group and the ESG Advisory Group with experience in advising in complex energy related disputes, environmental and all aspects of commercial and financial services, shareholder and regulatory disputes.
Emma has extensive experience in financial services having completed a 10 month secondment with Pepper Finance Corporation (Ireland) DAC in 2020. Emma was also previously seconded to the Central Bank of Ireland for six months in 2016 working in the Regulatory Decisions Unit on a large Inquiry under the Central Bank’s administrative sanctions procedure.
Emma regularly advises financial institutions and receivers in high profile summary judgment proceedings (including injunctive action) in the commercial court. This includes advising in relation to distressed loans involving non-cooperative borrowers, the obtaining of freezing orders, and the enforcement of security and related court proceedings including the initiation of bankruptcy proceedings following judgment orders obtained in the commercial court and the initiation of possession proceedings to secure vacant possession of secured assets, including issuing injunction proceedings against persons unknown residing in a secured asset and taking steps for attachment and committal of borrowers/occupants following non-compliance with Court Orders. Emma regularly advises in relation to shareholder disputes requiring, in some cases, the commencement of injunctive proceedings to prevent certain actions being taken vis a vis minority shareholders.
Emma also regularly advises on planning applications, including legal reviews of the application documents such as EIAR and NIS. She also advises on planning process and strategic infrastructure development procedure and gives workshops to developers on key planning issues and recent cases.
Emma also has experience advising clients in relation to complex and high value commercial disputes both cross-border and domestically including multi-party, multi-jurisdictional litigation.
