What is the current legal landscape for your practice area in your jurisdiction?<\/h4>\n<p>Since 2018, several amendments to Mexican industrial property legislation have entered into force, modifying a number of substantive and procedural requirements applicable to the prosecution of both trademarks and inventions. The most recent changes include the amendments to the FLLIP and the Regulations thereto, published in April 2026.<\/p>\n<p>By way of example, the maximum term of protection for Industrial Designs has been extended to 25 years. Prior to April 2018, the maximum term of protection for this right was 15 years. Likewise, before November 2020, Utility Models were protected for a term of 10 years; the current term of protection is 15 years.<\/p>\n<p>Additionally, in 2020, Mexico acceded to the Hague Agreement, making it possible to designate Mexico in international design applications. However, certain local legal requirements must still be complied with in order for such registrations to be effective in Mexico.<\/p>\n<p>More recently, the 2026 legislative reforms have introduced significant changes to patent prosecution. In particular, the examination process has been streamlined by reducing the maximum number of substantive Office Actions from four to two. The reforms also introduced the possibility of filing provisional patent applications, as well as a grace period allowing applicants to reinstate a patent application within 15 working days after the expiry of the final deadline for responding to an Office Action.<\/p>\n<p>These developments also require local counsel to respond with greater efficiency, technical expertise and certainty when advising clients and managing their intellectual property portfolios.<\/p>\n<h4>2. What three essential pieces of advice would you give to clients involved in your practice area matters?<\/h4>\n<p>In today\u2019s increasingly digital and competitive marketplace, intellectual property is no longer merely a legal consideration; it is a strategic business asset. Companies should therefore approach IP protection proactively, aligning their legal strategy with their commercial objectives and anticipating potential risks before they arise. From our perspective, we would highlight the following three recommendations:<\/p>\n<p><strong style=\"font-size: 1rem\">i. Prioritize the protection and strategic management of trademarks and distinctive signs.<\/strong><\/p>\n<p>A company\u2019s brands and other distinctive signs are often among its most valuable intangible assets. Obtaining appropriate protection at an early stage, conducting proper clearance and availability assessments, and maintaining an effective portfolio management strategy are essential to securing exclusive rights, mitigating the risk of third-party challenges, and preserving the commercial value of a brand. In an increasingly digital marketplace, this protection should also extend to monitoring and enforcing rights against unauthorized uses across online platforms and other relevant channels.<\/p>\n<p><strong>ii. Identify and protect copyright and other creative assets from the outset.<br \/>\n<\/strong>Businesses continuously create and disseminate valuable content, including advertising materials, software, websites, audiovisual works, photographs, publications, and other digital assets. Clients should ensure that ownership and rights of use are properly documented and that appropriate protection measures are implemented from the beginning. This is particularly important where content is developed by employees, contractors, agencies, or other third parties, as clear contractual arrangements can be critical to establishing ownership, securing the necessary rights, and facilitating enforcement against unauthorized use.<\/p>\n<p><strong>iii. Integrate intellectual property into the broader business and innovation strategy.<br \/>\n<\/strong>Intellectual property protection should not be viewed as a stand-alone legal exercise, but rather as an integral part of a company\u2019s overall business strategy. Clients should identify their most valuable innovations, creative assets, and distinctive elements and determine the most appropriate form of protection for each of them. By incorporating IP considerations into product development, commercialization, expansion, licensing, and investment decisions, businesses can reduce legal risks while maximizing the long-term value of their intangible assets.<\/p>\n<h4>3. What are the greatest threats and opportunities in your practice area law in the next 12 months?<\/h4>\n<p>Over the next 12 months, we expect the Mexican intellectual property landscape to present both increasing challenges and significant opportunities for businesses and their advisers. From a legal and strategic perspective, the principal challenges will arise from the increasing complexity of IP examination and enforcement, longer processing times before the Mexican Institute of Industrial Property (MIIP) and other relevant authorities, and the need to address increasingly sophisticated forms of infringement in the digital environment.<\/p>\n<p>The continued expansion of e-commerce, social media, digital marketplaces, and other online channels will also increase the exposure of brands and creative assets to unauthorized use, counterfeiting, and other forms of infringement. For rights holders, this will require a more proactive approach to monitoring, enforcement, evidence preservation, and the selection of appropriate legal and administrative remedies. At the same time, businesses will need to navigate increasingly complex questions concerning the ownership, use, and protection of intellectual property generated or exploited through new technologies.<\/p>\n<p>These challenges, however, are accompanied by substantial opportunities. The continued growth of innovation-driven industries, technology-based businesses, and digital commerce in Mexico is expected to increase demand for sophisticated IP advice. In particular, the adoption of artificial intelligence and other emerging technologies is likely to create new legal questions concerning copyright, authorship and ownership, brand protection, data-related issues, and the management and commercialization of intangible assets.<\/p>\n<p>From our perspective, one of the most significant opportunities for IP practitioners will be to move beyond a predominantly reactive approach to IP protection and provide clients with more integrated, business-oriented advice. This includes developing comprehensive IP portfolio strategies, identifying and mitigating risks at an early stage, structuring appropriate licensing and commercialization arrangements, and designing effective enforcement strategies.<\/p>\n<p>Overall, we expect the Mexican IP market to become increasingly strategic and technology-driven. Businesses that treat intellectual property as a core component of their broader commercial strategy\u2014and that obtain legal advice early in the development, acquisition, commercialization, and enforcement of their IP assets\u2014will be better positioned to protect their competitive advantage and maximize the value of their intangible assets.<\/p>\n<h4>4. How do you ensure high client satisfaction levels are maintained by your practice?<\/h4>\n<p>Undoubtedly, the legislative changes in Mexico have presented new challenges for our practice and day-to-day operations, requiring not only continuous monitoring of the evolving legal framework but also the implementation of the necessary updates to our internal processes and systems. They also reinforce the importance of keeping our clients fully informed of developments that may affect their intellectual property portfolios and prosecution strategies.<\/p>\n<p>For each matter entrusted to us, we work closely with our clients to recommend the most appropriate course of action, taking into account the available alternatives, the applicable legal framework, and the specific commercial and legal objectives of each case.<\/p>\n<h4>5. What technological advancements are reshaping your practice area law and how can clients benefit from them?<\/h4>\n<p>Technological advancements, particularly artificial intelligence (AI), data analytics and digital platforms, are significantly transforming the intellectual property landscape in Mexico. These technologies are changing the way intellectual property rights are created, protected, monitored and enforced.<\/p>\n<p>AI-powered tools are increasingly being used to improve trademark clearance searches, identify potential conflicts, monitor unauthorized uses of brands online and optimize intellectual property portfolio management. Similarly, digital platforms and automated systems are facilitating the filing, tracking and management of applications before intellectual property offices, improving efficiency and reducing administrative burdens.<\/p>\n<p>For clients, these developments provide opportunities to adopt more proactive and cost-effective IP strategies. Companies can benefit from earlier identification of potential risks, better management of global portfolios, faster decision-making processes and enhanced enforcement capabilities against online infringements and counterfeit activities.<\/p>\n<p>At the same time, emerging technologies create new legal challenges, particularly regarding ownership of AI-generated content, protection of digital assets and the adaptation of traditional intellectual property frameworks to new business models. As a result, clients will increasingly require strategic advice to ensure that their intellectual property assets remain adequately protected in a rapidly evolving technological environment.<\/p>\n<h4>6. Can you describe a particularly interesting or complex matter you have advised on recently, and explain the challenges involved, your approach, and the outcome achieved for the client?<\/h4>\n<p>One particularly complex matter involved advising a client in connection with multiple infringement claims brought by a third party that placed a valuable trademark portfolio at significant legal and commercial risk. The client\u2019s trademark registrations, which represented substantial brand equity and commercial value, were being challenged through proceedings seeking to restrict the client\u2019s use of its marks and, ultimately, to undermine the validity and enforceability of its registered rights.<\/p>\n<p>The principal challenge was to develop a comprehensive legal strategy capable of addressing both the immediate risks arising from the infringement claims and the broader, long-term protection of the client\u2019s intellectual property assets. We conducted a detailed assessment of the client\u2019s trademark portfolio, including the scope and status of the relevant registrations, the history and continuity of use of the marks, the claims and evidence advanced by the opposing party, and the applicable legal and procedural framework. Based on this analysis, we formulated a multi-layered defense strategy designed to reinforce the client\u2019s legal position, challenge the allegations of infringement, and preserve the validity and enforceability of the existing registrations.<\/p>\n<p>Our approach integrated contentious intellectual property strategy, trademark prosecution expertise, and proactive portfolio management. We developed and presented the relevant legal arguments, compiled and assessed documentary and evidentiary support establishing the client\u2019s legitimate rights and continuous use of the trademarks, and identified both procedural and substantive defenses that could be effectively raised in the proceedings. At the same time, we considered the broader implications of the dispute for the client\u2019s trademark portfolio and commercial operations, ensuring that the strategy adopted was aligned with the client\u2019s long-term business and brand protection objectives.<\/p>\n<p>As a result of the strategy implemented, we successfully safeguarded the client\u2019s trademark registrations and mitigated the risk of losing valuable intellectual property assets. The client was able to continue using its brands without interruption, while the matter further strengthened its overall position from an intellectual property risk-management perspective. The case also underscored the importance of maintaining a proactive and integrated approach to trademark prosecution, portfolio management, enforcement, and defense, particularly where commercially significant brands are exposed to third-party challenges.<\/p>\n<p>This strategy ultimately achieved the client\u2019s principal objectives, most importantly, safeguarding its interests and protecting the value of its intellectual property assets. This matter also reflects one of our firm\u2019s key strengths: our commitment to developing and implementing tailored legal strategies that are specifically designed around each client\u2019s particular circumstances, business objectives, and risk profile.
