There is no jury system in Thailand.<\/p>\n<\/div>\r\n\r\n\r\n\t\t\t\t\t<\/li>\r\n\r\n\t\t\t\t\t\t\t\t\t<li class=\"question-block filter-container__element\">\r\n\t\t\t\t\t\t<h3 class=\"filter-container__match-html\">What is the typical timeline and form of first instance patent litigation proceedings?<\/h3>\r\n\t\t\t\t\t\t<button id=\"show-me\">+<\/button>\r\n\t\t\t\t\t\t<div class=\"question_answer filter-container__match-html\" style=\"display:none;\"><p>After the patentee files a complaint with the CIPIT Court, the Defendant is served notice of complaint, which may then file a response to the complaint.<\/p>\n<p>After filing of the complaint and response thereto, the Court will fix a pre-trial hearing date to fix the issues for the case and the trial dates. The pre-trial hearing is usually scheduled about two (2) months after the complaint is filed, assuming the response is duly filed without multiple extensions.<\/p>\n<p>After the Court has fixed the issues for the case, the parties submit their affidavits and other documentary and material evidence in support of their cases. The deadline to submit affidavits along with any additional documents is usually one (1) week before the trial date, or as scheduled by the Court during the pre-trial hearing.<\/p>\n<p>The trial date largely depends on the availability of the Judges, and could be at least 4-6 months after the complaint is filed. After the trial is finished, both parties may submit their closing statements within the timeline set by the Judge. The CIPIT Court issues its judgment in around one (1) month after the submission of closing statements.<\/p>\n<p>The timeline for obtaining a judgement can be based on several factors, such as the volume of evidence presented, the complexity of the legal issues and technical issues in the present matter etc. In most instances where a plaintiff is asserting a claim of patent infringement against a defendant, the defendant is likely to raise counterclaim that the asserted patent is non-patentable or should not have been granted. The defendant may also bring forth a separate lawsuit for invalidating the plaintiff\u2019s patent. Therefore, before assessing the merits of the plaintiff\u2019s case, the CIPIT Court will assess the validity of the asserted patent claims before getting into the infringement analysis. This can add a delay to the usual timeline for rendering a judgment on the proceeding.<\/p>\n<p>In light of the above and pursuant to the new regulations, the CIPIT Court must announce its decision in a litigation case within one (1) year from the date of filing of the complaint.<\/p>\n<\/div>\r\n\r\n\r\n\t\t\t\t\t<\/li>\r\n\r\n\t\t\t\t\t\t\t\t\t<li class=\"question-block filter-container__element\">\r\n\t\t\t\t\t\t<h3 class=\"filter-container__match-html\">Can interim and final decisions in patent cases be appealed?<\/h3>\r\n\t\t\t\t\t\t<button id=\"show-me\">+<\/button>\r\n\t\t\t\t\t\t<div class=\"question_answer filter-container__match-html\" style=\"display:none;\"><p>Interim decisions from the CIPIT Court cannot be appealed until the matter before the CIPIT Court is fully adjudicated (i.e., a final decision is rendered). However, the opposite party against whom the interim decision is issued, has the right to raise an objection, which is officially recorded. If no objection is raised against the interim decision, the opposite party cannot file an appeal against such decision after the CIPIT Court issues its final decision.<\/p>\n<p>The final decision, however, may be appealed to the Specialized Court of Appeal within 1 month from the date of announcement of the first instance judgement. If any party is dissatisfied with the decision of the Specialized Court of Appeal, they may file a petition to the Supreme Court to accept the appeal, akin to a writ of certiorari, and the opposing party may submit an objection letter to said request.<\/p>\n<p>The Supreme Court is under no obligation to accept the petition, and will typically do to only in matters concerning public interest, a disagreement with the lower court\u2019s ruling, development of legal interpretation, and other issues as prescribed in the Notification of the President of the Supreme Court. The Court of Appeal\u2019s decision is final, unless the losing party files a review petition with the Supreme Court and it is accepted by the Supreme Court.<\/p>\n<\/div>\r\n\r\n\r\n\t\t\t\t\t<\/li>\r\n\r\n\t\t\t\t\t\t\t\t\t<li class=\"question-block filter-container__element\">\r\n\t\t\t\t\t\t<h3 class=\"filter-container__match-html\">Which acts constitute direct patent infringement?<\/h3>\r\n\t\t\t\t\t\t<button id=\"show-me\">+<\/button>\r\n\t\t\t\t\t\t<div class=\"question_answer filter-container__match-html\" style=\"display:none;\"><p>According to the Patent Act, in the case of product patents, the patentee has the exclusive rights to produce, use, sell, possess for sale, offer for sale, or import into Thailand the patented products.<\/p>\n<p>In the case of process patents, the patentee has the exclusive rights to use the patented process, produce, use, sell, possess for sale, offer for sale, or import into Thailand products manufactured via the patented process.<\/p>\n<p>Therefore, acts committed by a party that involve the exclusive rights enjoyed by the patentee and without said patentee\u2019s authorization, would constitute direct patent infringement.<\/p>\n<\/div>\r\n\r\n\r\n\t\t\t\t\t<\/li>\r\n\r\n\t\t\t\t\t\t\t\t\t<li class=\"question-block filter-container__element\">\r\n\t\t\t\t\t\t<h3 class=\"filter-container__match-html\">Do the concepts of indirect patent infringement or contributory infringement exist? If so, what are the elements of such forms of infringement?<\/h3>\r\n\t\t\t\t\t\t<button id=\"show-me\">+<\/button>\r\n\t\t\t\t\t\t<div class=\"question_answer filter-container__match-html\" style=\"display:none;\"><p>The Thai Patent Act does not explicitly account for indirect patent infringement or contributory infringement. For patent infringement, the patent owner can seek civil and\/or criminal remedies against the alleged infringer. Under the Thai Civil and Commercial Code, parties that jointly commit a tort shall be jointly liable for the damage caused from the tort.<\/p>\n<p>Since patent infringement is a tort, a party that induces or contributes towards patent infringement, would be held liable as a joint tortfeasor.<\/p>\n<p>In case of criminal proceedings where patent infringement is a criminal offence, the patentee may also rely on the Principal and Supporter provisions in the Thai Penal Code.<\/p>\n<p>In March 2022, the CIPIT Court issued a landmark ruling on the liability of an ecommerce platform for indirect IP infringement. The ecommerce platform was sued for indirect patent infringement for listing the patent infringing products. While ruling in favor of the ecommerce platform, the CIPIT Court held that the ecommerce platform was merely an online platform without the actual knowledge or intent of IP infringement. Also, the platform had robust notice and takedown mechanisms to remove the infringing listings upon receipt of notices.<\/p>\n<p>Thus, from the CIPIT Court\u2019s judgment, it appears that to establish indirect infringement, the actual knowledge as well as intent of committing the infringing activity are critical.<\/p>\n<\/div>\r\n\r\n\r\n\t\t\t\t\t<\/li>\r\n\r\n\t\t\t\t\t\t\t\t\t<li class=\"question-block filter-container__element\">\r\n\t\t\t\t\t\t<h3 class=\"filter-container__match-html\">How is the scope of protection of patent claims construed?<\/h3>\r\n\t\t\t\t\t\t<button id=\"show-me\">+<\/button>\r\n\t\t\t\t\t\t<div class=\"question_answer filter-container__match-html\" style=\"display:none;\"><p>The scope of protection for the patent claims are construed by reading the claims in conjunction with the specification. Claim construction will be an important aspect to ensure that the claims are properly interpreted (e.g., limitations from the specification should not improperly be imported into claims). For literal infringement, the exact language of the claims would be relevant. Section 36 bis of the Patent Act also accounts for infringement based on the doctrine of equivalents which permits a patent owner to argue that there is patent infringement even if the claims are not literally infringed, if a person with ordinarily skill in the art is likely to find that the allegedly infringing product\/process has substantially the same property(ies), function(s), and effect(s) of the claimed invention.<\/p>\n<p>Statements and\/or amendments made by the applicant as part of the prosecution history of the Thai patent and corresponding foreign patent can also determine the scope of the patent claims, especially with regards to the impact of said statements on the applicability of the doctrine of equivalents.<\/p>\n<\/div>\r\n\r\n\r\n\t\t\t\t\t<\/li>\r\n\r\n\t\t\t\t\t\t\t\t\t<li class=\"question-block filter-container__element\">\r\n\t\t\t\t\t\t<h3 class=\"filter-container__match-html\">What are the key defences to patent infringement?<\/h3>\r\n\t\t\t\t\t\t<button id=\"show-me\">+<\/button>\r\n\t\t\t\t\t\t<div class=\"question_answer filter-container__match-html\" style=\"display:none;\"><p>The defendant may assert that their activities do not fall within the scope of the claims or that their activities are exempted by the Act, including research exemptions, bolar exemptions (for pharmaceutical patents) etc. Additionally, the defendant may invalidate the patent or challenge the plaintiff\u2019s rights, such as whether the plaintiff is the rightful owner of the patent, the plaintiff\u2019s right to bring forth the lawsuit etc.<\/p>\n<\/div>\r\n\r\n\r\n\t\t\t\t\t<\/li>\r\n\r\n\t\t\t\t\t\t\t\t\t<li class=\"question-block filter-container__element\">\r\n\t\t\t\t\t\t<h3 class=\"filter-container__match-html\">What are the key grounds of patent invalidity?<\/h3>\r\n\t\t\t\t\t\t<button id=\"show-me\">+<\/button>\r\n\t\t\t\t\t\t<div class=\"question_answer filter-container__match-html\" style=\"display:none;\"><p>The substantive grounds for invalidity are that the claimed invention lacks novelty, inventive step, or industrial applicability, or that the claimed invention comprises non-patentable subject matter. For disproving the inventive step, multiple prior art documents may be combined, but there has to be a reason for combining said prior art documents. The protection term is 20 years from the date of filing. For applications under the PCT route, the maximum term of protection is 20 years from the international filing date. In case where there have been court proceedings such as an appeal against an opposition decision, the patent term shall not include the period during which the court proceedings have taken place.<\/p>\n<\/div>\r\n\r\n\r\n\t\t\t\t\t<\/li>\r\n\r\n\t\t\t\t\t\t\t\t\t<li class=\"question-block filter-container__element\">\r\n\t\t\t\t\t\t<h3 class=\"filter-container__match-html\">How are technical matters considered in patent litigation proceedings?<\/h3>\r\n\t\t\t\t\t\t<button id=\"show-me\">+<\/button>\r\n\t\t\t\t\t\t<div class=\"question_answer filter-container__match-html\" style=\"display:none;\"><p>As mentioned above, the CIPIT Court bench comprises three judges, one of whom is the main Judge, and two are associate judges. One of the associate judges is a qualified external expert with a specialized technical background pertaining to the case before the Court. Each party may also have their own technical expert, and each party can submit technical evidence such as documentary evidence, physical evidence, and expert witness reports documented in their list of evidence. Expert witness reports and \/ or testimonies, as well as technical evidence, can be challenged by the other party.<\/p>\n<\/div>\r\n\r\n\r\n\t\t\t\t\t<\/li>\r\n\r\n\t\t\t\t\t\t\t\t\t<li class=\"question-block filter-container__element\">\r\n\t\t\t\t\t\t<h3 class=\"filter-container__match-html\">Is some form of discovery\/disclosure and\/or court-mandated evidence seizure\/protection (e.g. saisie-contrefa\u00e7on) available, either before the commencement of or during patent litigation proceedings?<\/h3>\r\n\t\t\t\t\t\t<button id=\"show-me\">+<\/button>\r\n\t\t\t\t\t\t<div class=\"question_answer filter-container__match-html\" style=\"display:none;\"><p>There is no form of discovery akin to what happens in the United States, such as conducting depositions or preparing interrogatories.<\/p>\n<p>However, pursuant to the Regulation for IPIT Cases B.E. 2023, the patentee may file a motion in advance to seize or preserve the evidence of infringement in emergency cases. The motion must clearly state the facts and show that an emergency situation exists which requires seizure of evidence in advance of filing the infringement lawsuit.<\/p>\n<p>All supporting evidence and documents supporting each party\u2019s claims or defense can be submitted either at the time of filing the lawsuit, or with the Affidavit one week before the trial date.<\/p>\n<\/div>\r\n\r\n\r\n\t\t\t\t\t<\/li>\r\n\r\n\t\t\t\t\t\t\t\t\t<li class=\"question-block filter-container__element\">\r\n\t\t\t\t\t\t<h3 class=\"filter-container__match-html\">Are there procedures available which would assist a patentee to determine infringement of a process patent?<\/h3>\r\n\t\t\t\t\t\t<button id=\"show-me\">+<\/button>\r\n\t\t\t\t\t\t<div class=\"question_answer filter-container__match-html\" style=\"display:none;\"><p>If the patentee can prove that the product produced by the patented process is similar to the defendant\u2019s product, then the burden of proof will shift to the defendant to prove that they used a different process for producing the same product. To support the claim of process patent infringement, the patentee may seek assistance from independent institutions, laboratories etc. to analyze samples, conduct tests or hire appropriate experts to corroborate the claims.<\/p>\n<\/div>\r\n\r\n\r\n\t\t\t\t\t<\/li>\r\n\r\n\t\t\t\t\t\t\t\t\t<li class=\"question-block filter-container__element\">\r\n\t\t\t\t\t\t<h3 class=\"filter-container__match-html\">Are there established mechanisms to protect confidential information required to be disclosed\/exchanged in the course of patent litigation (e.g. confidentiality clubs)?<\/h3>\r\n\t\t\t\t\t\t<button id=\"show-me\">+<\/button>\r\n\t\t\t\t\t\t<div class=\"question_answer filter-container__match-html\" style=\"display:none;\"><p>Yes, the parties may request confidential hearings, where only the parties and the judges are permitted in the courtroom.<\/p>\n<\/div>\r\n\r\n\r\n\t\t\t\t\t<\/li>\r\n\r\n\t\t\t\t\t\t\t\t\t<li class=\"question-block filter-container__element\">\r\n\t\t\t\t\t\t<h3 class=\"filter-container__match-html\">Is there a system of post-grant opposition proceedings? Decisions from the United States and Europe dealing with the same issue would have persuasive value, but will not be binding.<\/p>\n<\/div>\r\n\r\n\r\n\t\t\t\t\t<\/li>\r\n\r\n\t\t\t\t\t\t\t\t\t<li class=\"question-block filter-container__element\">\r\n\t\t\t\t\t\t<h3 class=\"filter-container__match-html\">How does a court determine whether it has jurisdiction to hear a patent action?<\/h3>\r\n\t\t\t\t\t\t<button id=\"show-me\">+<\/button>\r\n\t\t\t\t\t\t<div class=\"question_answer filter-container__match-html\" style=\"display:none;\"><p>The CIPIT Court has exclusive jurisdiction over all intellectual property-related matters.<\/p>\n<\/div>\r\n\r\n\r\n\t\t\t\t\t<\/li>\r\n\r\n\t\t\t\t\t\t\t\t\t<li class=\"question-block filter-container__element\">\r\n\t\t\t\t\t\t<h3 class=\"filter-container__match-html\">What are the options for alternative dispute resolution (ADR) in patent cases? Are there any mandatory ADR provisions in patent cases?<\/h3>\r\n\t\t\t\t\t\t<button id=\"show-me\">+<\/button>\r\n\t\t\t\t\t\t<div class=\"question_answer filter-container__match-html\" style=\"display:none;\"><p>There are no mandatory ADR provisions in patent cases. It is advised to go for mediation so that the dispute can be settled off-court and so as to avoid the expenditure of time and money towards litigation. Both the Department of Intellectual Property and the CIPIT Court provide mediation services. Parties may engage in mediation both prior to filing an infringement lawsuit at the court and \/ or after filing the lawsuit, when the Judge grants the opportunity to conduct in-court mediation.<\/p>\n<p>Further, arbitration is recognized in Thailand under the Arbitration Act B.E. 2545 (2002). Parties can agree to have disputes resolved by arbitration, including patent infringement disputes.<\/p>\n<\/div>\r\n\r\n\r\n\t\t\t\t\t<\/li>\r\n\r\n\t\t\t\t\t\t\t\t\t<li class=\"question-block filter-container__element\">\r\n\t\t\t\t\t\t<h3 class=\"filter-container__match-html\">What are the key procedural steps that must be satisfied before a patent action can be commenced? Are there any limitation periods for commencing an action?<\/h3>\r\n\t\t\t\t\t\t<button id=\"show-me\">+<\/button>\r\n\t\t\t\t\t\t<div class=\"question_answer filter-container__match-html\" style=\"display:none;\"><p>Although there are no mandatory steps, prior to commencing litigation, it is recommended to serve the defendant with a cease-and-desist letter notifying them of their infringement.<\/p>\n<p>For a civil action, the plaintiff must bring forth the lawsuit within one year of becoming aware of the infringement and the identity of the infringer, or ten years from the date the infringement was committed.<\/p>\n<p>However, since patent infringement is also a criminal offence punishable by imprisonment of up to two years, the prescription period for prosecuting the offender (infringer) is ten years from the date of commission of infringement.<\/p>\n<\/div>\r\n\r\n\r\n\t\t\t\t\t<\/li>\r\n\r\n\t\t\t\t\t\t\t\t\t<li class=\"question-block filter-container__element\">\r\n\t\t\t\t\t\t<h3 class=\"filter-container__match-html\">Which parties have standing to bring a patent infringement action? Under which circumstances will a patent licensee have standing to bring an action?<\/h3>\r\n\t\t\t\t\t\t<button id=\"show-me\">+<\/button>\r\n\t\t\t\t\t\t<div class=\"question_answer filter-container__match-html\" style=\"display:none;\"><p>Only the patent owner has the right to bring an infringement action. For example, as seen in SEP litigation, one court may issue an anti-suit injunction restricting a party from initiating a lawsuit against the same opposing party in a foreign jurisdiction. In response to the issued anti-suit injunction, the restricted party may obtain an anti-anti-suit injunction.
