Are there cases that can or cannot be submitted to a specific sports tribunal or cannot be subject to arbitration (e.g. labor disputes)?<\/h3>\r\n\t\t\t\t\t\t<button id=\"show-me\">+<\/button>\r\n\t\t\t\t\t\t<div class=\"question_answer filter-container__match-html\" style=\"display:none;\"><p>The Kingdom of Bahrain has adopted the prevailing international approach in organizing the resolution and settlement of sports disputes, leaving it to the sports federations to resolve and settle disputes by the mechanisms prescribed within each federation. The statutes of national federations prohibit resorting to ordinary courts. For example, paragraph (1) of Article (74) of the Statutes of the Bahrain Football Association stipulates that: \u201cThe Association, its members, administrators, match agents, or players may not refer any dispute to ordinary national courts except pursuant to a specific provision of these Statutes or the FIFA Regulations.\u201d<\/p>\n<p>However, these statutes have also established mechanisms operating within the federations to address disputes related to their activities. For example, the Bahrain Football Association has formed the National Dispute Resolution Chamber (NDRC) in accordance with the model issued by FIFA.<\/p>\n<p>As a continuation of the dispute resolution system and to facilitate and simplify litigation procedures, the Kingdom of Bahrain launched the Sports Arbitration Rules in 2022 under the Bahrain Chamber for Dispute Resolution (BCDR). Under these rules, the Chamber adjudicates sports disputes where the statutes of sports federations and bodies provide for arbitration before the Chamber, or where the parties agree to it. Thus, disputing parties may resort to the BCDR to appeal the decisions of the dispute resolution committees within the federations, instead of referring to the Court of Arbitration for Sport (CAS).<\/p>\n<p>Arbitration under these rules is conducted under the auspices of the BCDR, which comprises a list of a number of specialists in sports law.<\/p>\n<p>It is noteworthy that the Court of Cassation of the Kingdom of Bahrain, in its judgment No. (9\/00066\/2024\/10) established a principle that ordinary national courts have no jurisdiction over any sports dispute where the statutes or regulations of sports federations stipulate the exclusion of national courts from deciding such disputes.<\/p>\n<p>As for alternative methods of resolving sports-related disputes in the Kingdom of Bahrain, Decree-Law No. (22) of 2019 on Mediation for the Settlement of Disputes permits the settlement of disputes through mediation in matters that are legally conciliable under Bahraini law. Since sports disputes are considered matters that may be amicably settled between the parties, there is no legal impediment to resolving them through mediation pursuant to the aforementioned law.<\/p>\n<p>In regard to the cases that may or may not be brought before the sports court in the Kingdom of Bahrain or that may not be subject to arbitration, there are no categories of sports disputes excluded from sports arbitration. Pursuant to the Sports Arbitration Rules of the Bahrain Chamber for Dispute Resolution (BCDR), any sports dispute may be referred to arbitration if the statutes of the sports federations and bodies so provide, or if the parties to the dispute agree to such arbitration.<\/p>\n<\/div>\r\n\r\n\r\n\t\t\t\t\t<\/li>\r\n\r\n\t\t\t\t\t\t\t\t\t<li class=\"question-block filter-container__element\">\r\n\t\t\t\t\t\t<h3 class=\"filter-container__match-html\">How is Sports law codified in your country? Is there a specific Statute or Code? Are there national sports authorities, independent agencies, or government ministries responsible for oversight?<\/h3>\r\n\t\t\t\t\t\t<button id=\"show-me\">+<\/button>\r\n\t\t\t\t\t\t<div class=\"question_answer filter-container__match-html\" style=\"display:none;\"><p>The Kingdom of Bahrain regulates sports affairs through a dual-track approach combining national legislation on the one hand and the statutes and regulations of sports bodies on the other.<\/p>\n<p>This approach reflects the nature of the relationship between the State and the sports sector, as the Bahraini legislator seeks to find a balance between the requirements of the public interest and the autonomy mandated by international sports bodies (such as international federations and the International Olympic Committee).<\/p>\n<p>On the one hand, national legislation \u2014 such as the Law on Associations, Social and Cultural Clubs, and Private Bodies Operating in the Field of Youth and Sports and Private Institutions issued by Decree-Law No. (21) of 1989, and Law No. (8) of 2021 on Sports Professionalism \u2014 constitutes the mandatory general framework that sets out the legal requirements for establishing sports clubs and federations, regulating sports professionalism, and contracting with professional athletes, and defines the scope of jurisdiction of the relevant government authorities.<\/p>\n<p>On the other hand, the statutes and regulations of the Bahrain Olympic Committee and the national sports federations serve as the internal governing framework of each sports entity. They set out in detail the procedural and organizational rules relating to membership, administrative structures, electoral mechanisms, sports discipline, financial management, and technical and sporting matters, in a manner that accommodates the specific nature of each sport and ensures compliance with the requirements of international federations and the International Olympic Committee.<\/p>\n<p>The combination of laws, statutes, and regulations in the allocation of legislative and regulatory functions constitutes an advantage that ensures the establishment of general binding rules at the national level through legislation. While the statutes and regulations of the federations translate these rules into detailed internal regulations that provide a degree of flexibility and autonomy to sports bodies, they do so without undermining the legislative sovereignty of the State.<\/p>\n<p>Regarding national sports authorities, independent agencies, or government ministries responsible for oversight, the Kingdom of Bahrain has multiple entities that supervise and oversee the sports sector. These entities are distributed between government authorities and national sports bodies to achieve a balance between national oversight and the autonomy required by the International Olympic Charter, as follows:<\/p>\n<ol>\n<li>Supreme Council for Youth and Sports:<br \/>\nThe highest authority in the field of sports, responsible for integrating youth and sports activities to develop socially, mentally, and physically sound citizens. It draws up the general policy for youth and sports programs across various fields and oversees their implementation.<\/li>\n<li>General Sports Authority:<br \/>\nThe governmental body responsible for implementing the policy of the Supreme Council for Youth and Sports and supervising the sports sector. It exercises financial oversight over clubs and sports federations within the limits of government subsidies granted to them. It is also the competent authority for implementing Decree-Law No. (21) of 1989 and Law No. (8) of 2021 on Sports Professionalism.<\/li>\n<li>Bahrain Olympic Committee:<br \/>\nA national non-governmental entity and a member of the International Olympic Committee, responsible for organizing administrative matters related to participation in the Olympic Games and ensuring that national sports federations comply with the International Olympic Charter.<\/li>\n<li>National Sports Federations:<br \/>\nEach national federation serves as the governing body for its sport within the Kingdom, responsible for establishing the technical and disciplinary regulations governing the sport it oversees.<\/li>\n<\/ol>\n<\/div>\r\n\r\n\r\n\t\t\t\t\t<\/li>\r\n\r\n\t\t\t\t\t\t\t\t\t<li class=\"question-block filter-container__element\">\r\n\t\t\t\t\t\t<h3 class=\"filter-container__match-html\">Advertising and marketing in sport: which are the limitations foreseen in your country, for instance in relation to alcohol, tobacco or betting advertising on or around sports infrastructure, on official clothing, etc.?<\/h3>\r\n\t\t\t\t\t\t<button id=\"show-me\">+<\/button>\r\n\t\t\t\t\t\t<div class=\"question_answer filter-container__match-html\" style=\"display:none;\"><p>With respect to advertising and marketing in sports in the Kingdom of Bahrain, the regulation of advertisements, in general, is governed by Decree-Law No. (14) of 1973 on the Regulation of Advertisements, which requires obtaining prior authorization for advertisements and prohibits any advertisement that conflicts with public security, public morals, or religious beliefs.<\/p>\n<p>Certain special laws also regulate advertising for specific categories of products. For example, the Public Health Law issued by Law No. (34) of 2018 introduced special provisions concerning the advertisement of certain products, including sports and bodybuilding foods. It prohibits their circulation or advertisement unless they are registered and a license for their circulation and method of advertising is obtained from the Ministry of Health, in accordance with the conditions stipulated in the Implementing Regulation issued by Resolution No. (13) of 2021. The Regulation further emphasized that advertisements must not encourage unhealthy dietary habits or lifestyles, nor conflict with the prevailing customs and traditions of society.<\/p>\n<p>As for alcohol, its consumption and sale are only permitted in designated and specified places. Its sale in regular shops and consumption in public or undesignated places is prohibited. Article (306) of the Bahraini Penal Code criminalizes being clearly intoxicated in a public or accessible place, and punishes anyone in a state of drunkenness who disturbs the peace of others. This context underlines the sensitivity of alcohol-related advertising in public spaces and reinforces the commitment of sports entities and their advertisers to public order and decency requirements.<\/p>\n<p>With respect to betting, the Bahraini Penal Code prohibits it under Article (308). Accordingly, advertisements for betting, or sponsorship of stadiums and jerseys by betting companies, are impermissible since the activity itself is criminalized.<\/p>\n<p>Regarding tobacco, Bahrain is among the States Parties to the World Health Organization Framework Convention on Tobacco Control, which requires each party to impose a comprehensive ban on all forms of tobacco advertising, promotion, and sponsorship. Law No. (8) of 2009 on Combating Smoking and Tobacco in all its types was enacted, prohibiting the advertisement of tobacco products in all public places and through all means of advertising. Subsequently, Resolution No. (3) of 2011 was issued, which imposed a comprehensive ban on any direct or indirect advertising or sponsorship of these products.<\/p>\n<p>Accordingly, it can be said that sports-related advertising in Bahrain is subject to strict oversight, whereby only advertising consistent with licensing requirements is permitted. In contrast, advertising of certain matters\u2014such as tobacco products and betting\u2014is completely prohibited, while advertising of alcohol and some special foods is restricted under the applicable legal and regulatory provisions, or due to conflicts with public order, religious beliefs, and prevailing social traditions. This includes banning the use of such advertisements in sports sponsorships, on official uniforms, or on billboards within or around sports facilities, practices that find no acceptance in the Bahraini regulatory framework.<\/p>\n<\/div>\r\n\r\n\r\n\t\t\t\t\t<\/li>\r\n\r\n\t\t\t\t\t\t\t\t\t<li class=\"question-block filter-container__element\">\r\n\t\t\t\t\t\t<h3 class=\"filter-container__match-html\">Match-fixing: How is match-fixing and other forms of match manipulation combated in your country? Has your country ratified the Macolin Convention? What is the role of the sports betting industry in your country and is it subject to any specific state regulations?<\/h3>\r\n\t\t\t\t\t\t<button id=\"show-me\">+<\/button>\r\n\t\t\t\t\t\t<div class=\"question_answer filter-container__match-html\" style=\"display:none;\"><p>Since the Kingdom of Bahrain regulates sports affairs through a dual-track approach\u2014combining national legislation on the one hand and the statutes and regulations of sports bodies on the other\u2014match-fixing falls under the criminal prohibitions of the Bahraini Penal Code, which penalizes acts of bribery, breach of trust, and fraud.<\/p>\n<p>On the other hand, the Bahrain Olympic Committee and the national sports federations have statutes and disciplinary regulations that contain explicit provisions prohibiting match-fixing or any unlawful influence on competitions.<\/p>\n<p>Sports federations monitor such matters and impose sanctions through their technical bodies and committees, which in some cases may include a lifetime ban from participating in any sports activity.<\/p>\n<p>Regarding the Macolin Convention: the Kingdom of Bahrain has not acceded to this convention.<\/p>\n<p>For the sports betting industry in the Kingdom of Bahrain, and as previously noted, betting is explicitly criminalized under Article (308) of the Penal Code issued by Decree-Law No. (15) of 1976. This legislative prohibition, reinforced by prevailing religious principles and socio-cultural considerations, has effectively precluded the emergence of a formal sports betting industry in Bahrain.<\/p>\n<\/div>\r\n\r\n\r\n\t\t\t\t\t<\/li>\r\n\r\n\t\t\t\t\t\t\t\t\t<li class=\"question-block filter-container__element\">\r\n\t\t\t\t\t\t<h3 class=\"filter-container__match-html\">Is there an institution safeguarding the integrity across sports in your country, e.g. ethics and doping violations or abuse cases? Which rules does such an institution apply?<\/h3>\r\n\t\t\t\t\t\t<button id=\"show-me\">+<\/button>\r\n\t\t\t\t\t\t<div class=\"question_answer filter-container__match-html\" style=\"display:none;\"><p>The Kingdom of Bahrain has a committee dedicated to combating doping in sports, known as the Bahrain National Anti-Doping Organization (BNADO). This committee operates in accordance with a national anti-doping regulation and implements the provisions and international standards issued by the World Anti-Doping Agency (WADA), as well as relevant international agreements, including the International Convention against Doping in Sport, to which the Kingdom of Bahrain is a party.<\/p>\n<p>Regarding other ethical violations, under Bahrain\u2019s dual-track approach to regulating sports affairs, such matters fall under the statutes and disciplinary regulations of national sports federations. These federations, through their respective bodies, are responsible for monitoring and addressing such ethical issues.<\/p>\n<\/div>\r\n\r\n\r\n\t\t\t\t\t<\/li>\r\n\r\n\t\t\t\t\t\t\t\t\t<li class=\"question-block filter-container__element\">\r\n\t\t\t\t\t\t<h3 class=\"filter-container__match-html\">How is corruption in sport regulated in your country? Is corruption between private individuals subject to criminal or civil liability and are there any sport specific corruption regulations?<\/h3>\r\n\t\t\t\t\t\t<button id=\"show-me\">+<\/button>\r\n\t\t\t\t\t\t<div class=\"question_answer filter-container__match-html\" style=\"display:none;\"><p>In light of the dual-track approach adopted by the Kingdom of Bahrain in regulating sports affairs, it can be indicated that the issue of corruption in sports is regulated on two levels: the first through national legislation, and the second through the statutes and regulations of sports federations.<\/p>\n<p>For example, Match-fixing can be criminalized, and imposing criminal liability under the general provisions of the Bahraini Penal Code, which prohibit bribery, breach of trust, and fraud.<\/p>\n<p>As for doping in sports, it is also regulated under the Bahrain Anti-Doping Regulation in Sports, issued by Decision No. (6) Of 2022. Moreover, regarding civil liability arising from any acts of corruption in sports, if such acts result in harm to others, the perpetrator shall bear civil liability toward the affected party. This is in accordance with the general principle established in the Bahraini Civil Code, which provides that any person who commits an unlawful act or negligence causing harm to another is obliged to compensate the injured party.<\/p>\n<\/div>\r\n\r\n\r\n\t\t\t\t\t<\/li>\r\n\r\n\t\t\t\t\t\t\t\t\t<li class=\"question-block filter-container__element\">\r\n\t\t\t\t\t\t<h3 class=\"filter-container__match-html\">How is fan behavior regulated by law (for example banning orders, criminal penalties for violence, specific laws addressing measures against violence at sporting events etc.)?<\/h3>\r\n\t\t\t\t\t\t<button id=\"show-me\">+<\/button>\r\n\t\t\t\t\t\t<div class=\"question_answer filter-container__match-html\" style=\"display:none;\"><p>The regulation of fans\u2019 behavior is governed by the statutes of the sports federations\u2014each within its jurisdiction\u2014and the disciplinary regulations issued by these federations. Sports federations monitor such matters and impose sanctions through their respective bodies and technical committees, in accordance with their regulations, including through the Disciplinary Committee of the federations.<\/p>\n<p>If a fan`s behavior results in acts of violence or harm to the safety and lives of others, or involves any defamation or insults, such actions may entail criminal liability for the fan responsible, in accordance with Chapter Eight \u2013 Offenses Against Persons of the Bahraini Penal Code issued by Decree-Law No. (15) of 1976, provided that such acts are established through investigation.<\/p>\n<\/div>\r\n\r\n\r\n\t\t\t\t\t<\/li>\r\n\r\n\t\t\t\t\t\t\t\t\t<li class=\"question-block filter-container__element\">\r\n\t\t\t\t\t\t<h3 class=\"filter-container__match-html\">What legal frameworks exist around the ownership and governance of professional sports clubs (e.g. foreign ownership restrictions, fan ownership models, licensing requirements)?<\/h3>\r\n\t\t\t\t\t\t<button id=\"show-me\">+<\/button>\r\n\t\t\t\t\t\t<div class=\"question_answer filter-container__match-html\" style=\"display:none;\"><p>The regulation of club ownership and management is governed by the Law on Associations, Social and Cultural Clubs, and Private Bodies Operating in the Field of Youth and Sports and Private Institutions, issued by Decree-Law No. (21) of 1989. According to this law, clubs are non-profit civil associations that may be established by natural or legal persons for the purpose of providing cultural, social, and physical youth services, or for offering national sports services.<\/p>\n<p>In 2020, the aforementioned law was amended by adding Article (62 bis), which permits the establishment of clubs in the form of commercial companies under the Commercial Companies Law issued by Decree-Law No. (21) of 2001, and allows clubs to change their legal status to commercial companies.<\/p>\n<p>Following this amendment, Decision No. (5) of 2021 was issued, specifying the types of companies that sports clubs may adopt, the rules governing their operations, and the mechanisms for their supervision. This decision defined the permissible forms of companies for clubs, including technical and administrative rules and oversight mechanisms.<\/p>\n<p>Notably, the decision specified the types of companies that clubs may adopt into two forms: the limited liability company and the closed joint-stock company. In addition, it restricted ownership of shares and stakes in clubs to Bahraini nationals only.<\/p>\n<\/div>\r\n\r\n\r\n\t\t\t\t\t<\/li>\r\n\r\n\t\t\t\t\t\t\t\t\t<li class=\"question-block filter-container__element\">\r\n\t\t\t\t\t\t<h3 class=\"filter-container__match-html\">Do you observe an increase in multi-sport ownership in your country, either across various sports or within one sport or sports discipline?<\/h3>\r\n\t\t\t\t\t\t<button id=\"show-me\">+<\/button>\r\n\t\t\t\t\t\t<div class=\"question_answer filter-container__match-html\" style=\"display:none;\"><p>This phenomenon is not yet widespread in the Kingdom of Bahrain, as most sports clubs still operate in the form of civil associations.<\/p>\n<p>Although the concept of clubs operating as commercial companies was legally recognized in 2020 through the amendment of the Law on Associations, Social and Cultural Clubs, and Private Bodies Operating in the Field of Youth and Sports and Private Institutions, issued by Decree-Law No. (21) of 1989, the number of sports clubs adopting the commercial company model remains limited. Consequently, the practice of multi-sport ownership has not gained significant prevalence in the Bahraini sports sector.<\/p>\n<\/div>\r\n\r\n\r\n\t\t\t\t\t<\/li>\r\n\r\n\t\t\t\t\t\t\t\t\t<li class=\"question-block filter-container__element\">\r\n\t\t\t\t\t\t<h3 class=\"filter-container__match-html\">Are there any mandatory national provisions, apart from regulations of international sports governing bodies, which regulate athlete representation in your jurisdiction and are there specific limitations to the representation of athletes, such as e.g. provisions regarding dual representation, caps on agent commissions, regulations on the protection of minor athletes?<\/h3>\r\n\t\t\t\t\t\t<button id=\"show-me\">+<\/button>\r\n\t\t\t\t\t\t<div class=\"question_answer filter-container__match-html\" style=\"display:none;\"><p>Regarding the representation of athletes in the context of sports contracts, this matter is regulated in the Kingdom of Bahrain through the regulations of each sports federation, in accordance with the rules applicable to each sport.<\/p>\n<p>For example, the Bahrain Football Association issued regulations governing the profession of football player agents. Among the provisions included in these regulations is the prohibition of a football agent providing services to more than one party in a single transaction, thereby prohibiting dual representation by the agent in the same transaction.<\/p>\n<p>The regulations also govern the representation of minor athletes to ensure their protection. Additionally, the regulations set a maximum cap on the fees that may be charged by football agents for their services.<\/p>\n<p>As for the protection of minor athletes, this matter is also regulated in Bahrain through the regulations of each sports federation, in accordance with the rules applicable to each sport.<\/p>\n<p>For instance, the Bahrain Football Association\u2019s Regulations on Player Status and Transfers include a Chapter (Chapter Five) that governs the transfer of minor athletes. Also, it established controls and restrictions on transfers involving minors to ensure their protection and to provide social and psychological stability.<\/p>\n<\/div>\r\n\r\n\r\n\t\t\t\t\t<\/li>\r\n\r\n\t\t\t\t\t\t\t\t\t<li class=\"question-block filter-container__element\">\r\n\t\t\t\t\t\t<h3 class=\"filter-container__match-html\">Are there national statutory frameworks, apart from regulations of international sports governing bodies, or cases concerning the participation of transgender athletes in competitive sport in your country? How is the issue currently regulated and\/or debated?<\/h3>\r\n\t\t\t\t\t\t<button id=\"show-me\">+<\/button>\r\n\t\t\t\t\t\t<div class=\"question_answer filter-container__match-html\" style=\"display:none;\"><p>There is no national regulation regarding this matter in the Kingdom of Bahrain, as there are no known precedents or cases in this regard. Consequently, there has not yet been a need to establish such regulations on this issue.<\/p>\n<\/div>\r\n\r\n\r\n\t\t\t\t\t<\/li>\r\n\r\n\t\t\t\t\t\t\t\t\t<li class=\"question-block filter-container__element\">\r\n\t\t\t\t\t\t<h3 class=\"filter-container__match-html\">What is the legal framework for e-sports in your jurisdiction? Is there a specific Statute or Code in your country or motions to implement such?<\/h3>\r\n\t\t\t\t\t\t<button id=\"show-me\">+<\/button>\r\n\t\t\t\t\t\t<div class=\"question_answer filter-container__match-html\" style=\"display:none;\"><p>In fact, there is currently no specific legal framework for eSports in the Kingdom of Bahrain. However, Bahrain has recently begun to pay attention to this field, with the establishment of the Bahrain eSports Federation in 2020.<\/p>\n<p>Over the past five years, there has been a noticeable increase in the number of registered players with the federation, as well as an increase in the number of clubs participating in eSports. Accordingly, with this growing interest in eSports in Bahrain, it is expected that the federation will expand its activities by organizing regular competitions.
