Position

Barrister specialising in commercial and traditional chancery litigation and advice, including pensions, professional negligence, trusts, fraud, wills, financial services, commercial property and commercial contracts. Significant recent cases include: Guinness Peat Group [2015] – an investigation by the UK Pensions Regulator into the possible exercise of its ‘moral hazard’ powers; Ridgeland Properties Ltd v Matthews & Goodman LLP and ors [2014] – a professional negligence claim about legal advice concerning the compulsory purchase of land; Acorn Country Capital Ltd [2014] – professional negligence proceedings concerning a mortgage valuation; Entrust Pension Ltd [2013] Pens LR 73 and [2012] Pens LR 341 – claims concerning the construction of pension scheme documentation and the exercise of trustee’s powers and duties; PCP Capital Partners Ltd and ors v Bogolyubov and ors [2012] – claims for contractual fees arising on the procurement of sale of property; Lambert and ors v Peters and ors [2011] – claims of fraud relating to the operation of a private family settlement, a will trust and a property investment company; Bamford v EDS [2011] – claim concerning the operation of the duty of trust and confidence in the context of a claim for early retirement under a pension scheme; the Pilots litigation [2010] EWHC 1573 – described the ‘The Lawyer’ as one of the top ten cases of 2010; Musawi v Bevis Trustees Ltd [2009] EWHC 1915 – an appeal from the pensions ombudsman concerning a transfer of pension benefits.

Career

Called 2005, Lincoln’s Inn; judicial assistant to Lord Phillips, the Lord Chief Justice, for the Michaelmas term 2006; publications include ‘Pension trustees’ duties of care and skill’ (October 2009, Practical Law Company, with Jonathan Evans) and ‘Trust to the Future’ (December 2007, New Law Journal Vol 157, with Michael Furness QC).
