David has a broad practice encompassing professional negligence, property damage, personal injury and insurance work. He takes on extensive advocacy and advisory work for both claimants and defendants.

Professional Liability

David takes on professional liability claims concerning solicitors, barristers, brokers, architects and surveyors. Recent cases include: representing a QC accused of undersetting a high value solicitors’ negligence claim; defending a building services consultant who designed a ‘low carbon’ heating system for a prestigious residential property; representing personal injury solicitors alleged to have negligently concluded a range of injury actions.

Property Damage

David advises and appears in flood, fire and defective premises claims. He also has a busy tree root subsidence practice. Recent cases include: acting in a significant tree root claim arising out of subsidence damage and remedial underpinning to a prestigious Victorian property in Hampstead; advising and representing a rural householder in a flooding claim against an international cider producer; advising and pursuing recovery actions following a series of fires at a fast food restaurant chain.

Personal Injury/RTA

David has a busy court practice representing insurers in all manner of personal injury/RTA claims (including credit hire, PL and EL matters). He has particular experience in defending fraudulent claims including phantom passenger claims and staged accidents.


David advises insurers and insureds on a wide variety of coverage and claims issues. David also has a niche practice concerning claims made on permanent health and critical illness insurance policies, where he draws upon his experience of insurance and personal injury work. Recent cases include: advising on scope of notification and aggregation issues under the solicitors’ MTC; representing insurers in respect of coverage issues under a new home guarantee policy; advising insurers in respect of claims on permanent disability policies made by claimants with CFS.

The ‘impressive’ members at 2TG – 2 Temple Gardens are ‘responsive and professional’ and the set has a ‘good mix of senior and junior counsel to call on’ for professional negligence work. Charles Dougherty QC successfully appeared in the Court of Appeal, acting for the respondent in Schubert Murphy v Law Society, which raised the issue of the professional body’s duty of care to solicitors and the public. Dougherty also led David Thomas and Isabel Barter in Gaze v HS, acting for a silk and Bar Mutual in a £15m claim brought against the claimant’s former solicitors and counsel arising out of earlier unsuccessful litigation.
