Lectures presented: Sep 2011 – Regulation 5(1) of the Workplace Health Safety and Welfare Regulations (1992) – ‘When is Strict Liability not Strict Liability?’ – an analysis of recent case law on the restrictive interpretation of Regulation 5 of the Workplace Regulations 1992, including consideration of its inter-relationship with Regulation 12 (which deals specifically with defects in/on floors and traffic routes) and a discussion of the probable and practical limits of Regulation 5 as a general purpose strict liability provision.
