Specialist in asset recovery and proceeds of crime particularly in the areas of restraint, receivership, confiscation and insolvency. A commercial litigator whose practice encompasses complex and high value cases: civil fraud litigation; asset recovery; civil recovery; bribery; corruption; insolvency; fraud; and money laundering. Acts for Liquidators intervening in POCA cases. Recent cases include advising the former Director (Aviation) in the now abandoned Rolls Royce criminal corruption investigation; acting for the SFO as restraint Counsel in several major fraud/corruption Operations; obtaining the SFO’s first account freezing order in the sum of £1.4M; advising the SFO on obtaining external POCA orders for the Indian Government); acting for the FCA as confiscation Counsel in insider trading and boiler room fraud cases; and being heavily engaged in management receivership proceedings involving property portfolios/assets in excess of £100m. Recent High Court actions have included: successfully setting aside a summary judgment recovery order in civil recovery proceedings and thereafter successfully settling all the claims; banking frauds; and theft employee frauds. Regularly instructed on behalf of court appointed management and enforcement receivers in high value receiverships. International work has included acting for Attorney General of the Turks & Caicos Islands in civil proceedings. Barry acts for the following prosecution agencies: SFO and the FCA.
