Position

Simon practises in the area of public procurement law, competition, regulation and public law. He was formerly a solicitor and antitrust partner at a major national firm. His practice combines contentious and non-contentious work, including public procurement disputes for bidders and authorities and strategic advice to authorities or utilities on the conduct of tenders, competition disputes and state aid investigations. He advises on competition and regulatory issues arising from disputes, transactions and commercial agreements, covering merger control and the prohibitions on anti-competitive conduct and abuse of dominance. He has specific expertise in the healthcare sector and frequently acts for NHS bodies on procurement and competition-related disputes. He also specialises in sector specific economic  regulation in the rail, communications, energy and water sectors. He has appeared in several reported hearings in the TCC and Admin Court. He has also acted on mediations and trials for the Bar Pro Bono Unit and the Free Representation Unit. Recent cases include Kent Community Health NHS Foundation Trust v NHS Swale CCG and Ors, [2016] EWHC 1393 (TCC), Heathrow Airport Ltd v Office of Rail And Road [2017] EWHC 1290 (Admin) (26 May 2017) and R (Hersi & Co Solicitors) v The Lord Chancellor (as successor to the Legal Services Commission), [2017] EWHC 2667 (TCC).
