Recent matters have concerned energy disputes (delay claim arising out of the construction of a wind farm; final account and termination dispute arising out of Pembroke power station; delay claim arising out of the construction of a waste to energy power plant), infrastructure projects (maintenance of trunk roads and other transport projects; various PFI projects; two unrelated disputes arising out of the 2012 Olympics) and building projects. Recent reported cases: Parkwood v Laing O’Rourke (whether a collateral warranty is a construction contract); U&M v Konkola Copper Mines plc (whether a party to an agreement for arbitration in London is entitled to obtain interim relief in the jurisdiction local to the project); Atkins Ltd v Secretary of State for Transport (appeal from an arbitrator’s decision: compensation events under NEC3); Alstom Power v SOMI (claim for a mandatory injunction); Rust v PB Ltd (whether a judgment entered by consent was binding upon an indemnifier).
