Position
Emmaline specialises in planning, environmental, public law and regulatory crime.
She appears regularly at numerous planning inquiries covering appeals under s.78, enforcement notice appeals and CPO inquiries (including references to the Lands Tribunal).
Emmaline has significant experience of enforcement matters both in prosecuting and defending breaches of enforcement notices, including POCA proceedings, and in the use of injunctions to remedy breaches of planning control. She is currently instructed by local planning authorities in relation to large housing schemes in West Berkshire, Horsham and Swale.
Emmaline’s experience in public law covers a wide range of work including highways, housing, anti-social behaviour, licensing and homelessness and she has acted for local authorities in section 204 appeals. She has been instructed by two local authorities in relation to disciplinary proceedings under the Local Authorities (Standing Orders) (England) Regulations 2001.
Emmaline is regularly instructed to settle proceedings and appear in Judicial Review proceedings and various statutory challenges. She is approinted to the Panel of Specialist Regulatory Advocates for the Health and Safety Executive, the Envornment Agency and the Office of Rail Regulation.
