Personal injury and professional (clinical and legal) negligence litigation, predominantly employers’ liability and road traffic accident claims. Considerable experience in high value catastrophic injury and Fatal Accident Act work. Reported decisions of interest include Verlander v Rahman [2012] EWHC 1026 (serious brain injury claim about which there was substantial disagreement between the medical experts both as to consequences and, particularly, Mental Capacity), Connery v PHS [2011] EWHC 1685 (a Complex Regional Pain Syndrome developing as a consequence of a whiplash injury); Hardisty v Aubrey [2006] EWCA Civ 1196 (road traffic accident claim – the Court of Appeal reversing a finding of fact made erroneously by the trial judge upon an incomplete assessment of the totality of the evidence on the issue); Harris v BRB (Residuary) Ltd [2006] PIQR P10 (noise induced hearing loss claim – appeal on issues of noise exposure and use of hearing protection); Godbold v Mahmood [2006] PIQR Q5 (high value brain damage claim including a substantial periodical payments award); Pirelli General Plc v Gaca [2004] I WLR 2683 (employer’s liability claim – appeal on issue of deduction of insurance receipts); Edmonds v Lloyds TSB Bank plc [2004] EWCA 1526 (employer’s liability claim – appeal on issue of failure to mitigate loss).
