A versatile and experienced practitioner in commercial and property law with specialist property litigation experience in a number of niche areas.

Key areas of expertise include:

  • Boundaries, easements and conveyancing disputes
  • Landlord and tenant-business lease renewals, dilapidations and residential disputes including the fitness standard under the 2004 Housing Act and tenancy deposit problems
  • Commercial remedies and relief including freezing injunctions and disputes about title to frozen property
  • Trusts and probate and estates including challenges to wills and other documents based on lack of capacity
  • Rectification and other claims before property tribunals including the First Tier Tribunal -Land Registration Division
  • Town and village greens and highways both in court and in public inquiries
  • Business rates-advising both billing authorities and rate payers in relation to liability for non-domestic rates and avoidance measures.
  • Professional negligence arising out of property transactions
  • Negligence and breach of duty claims arising out of the misselling of mortgages and other financial products linked to property, equity release schemes and their aftermath, liability of banks and building societies and possible clawback of losses from professional advisers
  • Disputes between neighbours over nuisance and liability for drainage, slippage and under-cutting land, tree root damage and damage by fire including claims under the Fires Prevention (Metropolis) Act
  • Land contamination claims by and against local authorities as well as claims arising out of their duties under the Building Act 1984 and related legislation

  • Advising a large local authority in relation to all its business leases
  • Advising and drafting statements of case in relation to a dispute over a  mining lease/landfill waste site and related legal issues before the First-tier Property Tribunal
  • Advising a local authority in relation to the introduction of a public spaces protection order
  • Advising objectors in relation to a traffic management order
  • Hillas Properties Limited v Playwrite Group (county court- successfully represented landlord who relied on section 30 (1) (f) of the LTA 1954 in relation to Greenholme Mills)
  • Brown v Helena Housing [2015] UKUT 0324 (LC) (whether service charges properly levied by housing association)
  • R (On the application of Barkas) v North Yorkshire County Council and Scarborough Borough Council [2014] UKSC 31 (whether a recreation ground can be registered as a town or village green)
  • Preston City Council v Oyston Angel Charity [2012] EWHC 2005 (liability of a charity for business rates on unoccupied premises)
  • Successfully representing the registration authority at the inquiry into the Churchfield site in Huddersfield in 2012.
