Barrister specialising in pensions, employment and discrimination law. Particular expertise in the areas of crossover between employment and pensions law, including issues arising under TUPE, breach of trust and confidence, pension-related discrimination claims, disputes arising in relation to statutory schemes (LGPS, TPS, USS and NHS) and redundancy situations. Recent pensions cases include: acting for the representative beneficiaries in the IBM v Dalgleish remedies hearing (led by Nicolas Stallworthy QC); acting for the Fire Brigades Union (led by Antony White QC) in a Part 8 claim concerning age discrimination in pension provisions brought by the Secretary of State for Communities and Local Government; advising The Pensions Regulator; acting for the company in a high-value and complex equalisation claim (led by Richard Hitchcock QC). Substantial experience of all areas of employment law, including all types of discrimination (as well as equal pay), agency workers, whistleblowing and restrictive covenants. Represents companies, individuals and trade unions. Recent cases include: Weerasinghe v Basildon & Thurrock NHS Trust (2015) – EAT appeal and cross appeal following successful whistleblowing claim by a surgeon at a failing hospital; Amissah & Others v London Underground & another – multi-party claim brought under the Agency Workers Regulations. Lydia has a particular interest in sex discrimination claims in the financial services sector, and is representing two claimants in currently confidential very high-value claims in that sector.
