Work Department

Corporate recovery/restructuring and insolvency.

Tim leads the corporate recovery and insolvency group. He has a great deal of experience and expertise across the spectrum of insolvency law and practice. Tim advises insolvency practitioners, banks, directors, creditors, individuals, and any other party which becomes an unwilling participant in the insolvency process. He is a member of the Insolvency Lawyers’ Association and The Association of Business Recovery Professionals. In relation to contentious issues, Tim is known for his tenacity in trying to get a deal done quickly. He is always willing to get involved at the early, investigatory stage to work with the insolvency practitioner to devise a strategy and then deliver it. Anyone who finds themselves on the wrong side of an insolvency action, such as a director, bankrupt, or co-owner of the family home, will benefit from Tim’s thorough understanding of the defences available under Insolvency law to either defeat the claim, or, if that is not possible, to negotiate the best possible outcome. Recent work highlights include: acting for a liquidator on a £2m misfeasance; acting for a trustee in bankruptcy on £900,000 transactions at undervalue; pre-pack sale of a music magazine; pre-pack sale of a CGI post production business; acting for a litigator to recover £1m of post-petition dispositions; acting for a trustee in bankruptcy to release £2m worth of real estate.

DMH Stallard LLP's insolvency practice focuses more on contentious than advisory matters and represents practitioners, banks and asset-based lenders, company directors, creditors, and landlords and tenants, as well as individual bankrupts. Key areas of work include administrations, injunctions, fraud and asset tracing matters, property realisation, voluntary arrangements, security enforcement and defence against disqualification or misfeasance claims. The 'excellent' Tim Symes 'combines his extensive specialist insolvency legal knowledge with common sense and a commercial approach to difficult recoveries'. In a recent highlight, he assisted a national charity with the purchase of £1m-worth of procurement contracts from a similar organisation in administration and with ascertaining a secured creditor position. FRP Advisory, Begbies Traynor and Menzies are long-standing clients, while Harveys and McTear Williams & Wood instructed the practice for the first time. After the team merger with Rawlison Butler in August 2017, commercial litigation associate Liane Simmonds joined the firm.

  • Doing business in Ukraine: turning point for the currency control in Ukraine

One of the most hotly discussed topics in 2019 is currency control liberalization in Ukraine. The currency control liberalization was one of Ukraine‚Äôs priorities under the EU-Ukraine Association Agreement. At the beginning of 2019 the National Bank of Ukraine (hereinafter the ‚ÄúNBU‚ÄĚ) approved and promulgated all long-awaited regulations, serving as the basis for a new liberal¬†system of foreign currency control. The new¬†currency control¬†system will be launched on 7 February 2019, the same day as the Law of Ukraine¬† On Currency and Exchange Transactions¬† becomes applicable. The changes are aimed at deregulation, facilitating cross-border transactions with foreign currency and expanding the list of available foreign currency transactions.

The United Arab Emirates (the UAE ) promulgated legislation to specifically address the regulation of competition (being Federal Law 4 of 2012, or the Competition Law ) several years ago but until recently, it has been the case that the requisite implementing regulations and processes were not in place. This is no longer the case. Not only have the much anticipated implementing regulations been issued, the UAE Ministry of Economy (the Ministry ) (being the regulator in charge of administering the UAE competition regime) has now formed the required committee and issued the anticipated guidance and forms to allow concerned parties to make merger clearance submissions to the Ministry where required to do so pursuant to the Competition Law.
