Position

David has a substantial personal injury practice acting for both claimants and defendants in employers’ liability (including industrial disease), public liability, occupier’s liability, product liability, highway tripping, Animals Act and road traffic claims (including LVC). David has an established clinical negligence practice in a broad range of specialisations. Notable cases include: R v Powys Local Health Board and Anuerin Bevan Health Board (2010) – the defective repair of R’s incisional hernia led to her developing a large debilitating abdominal hernia and significant abdominal scarring. The stress of the event caused R to lose her hair; O (A child) v North Bristol NHS Trust (2010) – O (A child) was born with a complex congenital heart disease. A failure to repair the septal defect led to poor cardiac function and O died; S v Northern Devon Healthcare Trust (2010) – S suffered an extravasation injury whilst in ITU, when Calcium Gluconate was forced into a cannula that had “tissued” in her left arm despite there being a central line in situ. S required a skin graft on her arm; B v Trant Construction Ltd (2011) – the Claimant sustained hand / arm vibration syndrome following prolonged work on a site under the control of the Defendant; J v Continental Teves (UK) Ltd (2010) – J suffered right medial epicondylitis, as a result of working upon a production line where she was given insufficient rest periods and limited rotation of tasks.

Career

Called 2005; Inner Temple. David qualified in medicine in 1998 and practised as a doctor prior to coming to the Bar.
