Position

Areas of practice include: environmental law of all kinds (liability, regulatory, public law, planning, criminal and also claims against environmental and planning consultants), general professional negligence (especially lawyers and construction professionals), clinical negligence (especially cerebral palsy and claims arising out of the Human Tissue Act), administrative law (including local government); domestic commercial contract (including arbitration); public enquiries. Cases include: Redfern inquiry into human tissue in the nuclear industry. (2008-9). Morgan v Hinton Organics (CA, Arhus convention, 2009); Watson v Croft Promosport (CA, injunction against motor racing circuit, 2009); Dobson v Thames Water (CA, human rights damage 2009); R (Thames) v Environment Agency (ECJ & Div Ct, 2007 – 8 – is escaped sewage waste); R (McCaw) (Arhus/ PCOs Div Ct, 2008); United Utilities v Environment Agency (HL, PPC, 2007) Lennie (CA, cerebral palsy/ forceps delivery 2006); Nationwide Organs Litigation (2004); Dennis v MoD (2003), Harrier jump jets); Cambridge Water v Eastern Counties Leather [1994] 2 AC 264 HL; HMIP v Coalite; Clifton v Powergen ENDS Vol 272 p3; Bowden v South West Water [1998] Env LR 445 CA; R v Falmouth Port Health Authority ex p South West Water [2001] QB 445 CA; accepts direct professional access.

Career

Called 1982; QC 2003; Middle Temple; publications: editor of 2nd edition of Environmental Law (Burnett-Hall & Jones, 2009) and contributor of chapters on waste, flooding, water abstraction and water pollution. Regular contributor to Environment Liability (including 2009 article with Rachel Marcus on the polluter – pays principle).
