Barrister specialising in employment and discrimination law; experience includes CA; EAT; and a wide variety of employment tribunal work, including lengthy discrimination hearings. Also practises in PI and clinical negligence (HC, CC and CICA) and has experience of hearings before professional disciplinary bodies. Jointly instructed by the EOC, CRE and DRC to intervene (as Robin Allen’s junior) in the joined ‘burden of proof’ cases (Igen Ltd v Wong; Chamberlin Solicitors v Emokpae; Brunel University v Webster) CA, February 2005. Has acted as junior counsel in two important equal pay test claims: Hartley v Northumbria Healthcare NHS Trust, a challenge to the NHS pay scheme, Agenda for Change, which affected hundreds of thousands of NHS employees, and Williams and Jermin v DFT, the first claim to compare employees in two different government agencies. Reported cases include Elstone v BP (EAT March 2010), the first authority for the proposition that a worker who makes a protected disclosure in one employment is protected against detriment in a subsequent employment, and JP Morgan (Europe) Ltd v Chweidan (CA, May 2011), a case concerning the distinction between direct and disability-related discrimination. In recent years has been invited to address a European Commission seminar in Brussels, the annual conference of the Bar European Group and the Industrial Law Society’s Oxford conference on issues relating to employment and discrimination law.
