Position

Barrister specialising in commercial litigation and arbitration, EU/competition and public law, with a particular interest in cases dealing with more than one area of law, e.g. cases that combine commercial elements with other areas.

Sarah works across the full range of competition law disputes, including competition follow-on claims and regulatory investigations and appeals (including in the merger context).  For instance, she was instructed for the Claimant in Unwired Planet v Huawei, Samsung & Google, major competition litigation raising issues relating to FRAND terms for the licensing of intellectual property rights.  In the CJEU and General Court, Sarah acted as junior counsel for Panasonic Corporation in its appeal to the General Court against the Commission Decision finding a cartel in the market for cathode ray tubes (Case T-82/13, judgment of 9 September 2015).

Recent important administrative/public law cases include R (WXYZ) v Secretary of State for Health [2015] EWCA Civ 1034, concerning the sharing of patient data for the purpose of imposing immigration sanctions.  Sarah also has expertise in Francovich claims.

Current important commercial cases include Canal & River Trust v Thames Water Utilities Ltd [2016] EWHC 1547 (Ch) (acting for the Defendant to Part 8 proceedings regarding an alleged statutory obligation to make payments to another entity).
