The set’s ‘enviable choice of counsel, both junior and senior’, appears in significant inquiries, promoting large urban extensions, as well as major mixed-use developments and tall buildings. Heather Sargent acted for Marks and Spencer after its application to demolish and rebuild its flagship store at Marble Arch, Oxford Street was called-in by the Secretary of State; Matthew Fraser represented the main objector, SAVE Britain’s Heritage, during the two-week public appeal. Fraser, led by David Elvin KC acting for Horse Hill Developments, was also one of several members involved in R (Finch) v Surrey County Council, a case concerning the scope of environmental impact assessments of hydrocarbon extraction projects, and its application – Richard Moules KC represented the Secretary of State in the same case Court of Appeal and led Nick Grant in the ongoing appeal in the Supreme Court. Crossing over with the set’s expertise in planning and public law, Landmark Chambers have established themselves as a leading set across all aspects of property litigation including landlord and tenant and real estate disputes, as well as more niche areas such as telecommunications, protestor injunctions and village greens. Tom Weekes KC led Richard Moules KC in Fearn v Tate Trustees, a Supreme Court case in which the residents of a development of luxury flats were found to have been subjected to a nuisance by the viewing gallery on top of the Tate Modern’s Blavatnik Building. Simon Allison and Kimberley Ziya represented the successful appellant in FirstPort Property Services Limited v Settlers Court RTM in a landmark decision concerning the statutory right to manage blocks of flats. Timothy Morshead KC represented the energy company in Breen v Esso Petroleum, securing an injunction, and then the committal to prison for contempt of court of an individual who breached it by digging a tunnel in an attempt to stop the construction of the London Pipeline Project, based on economic torts rather than the law of nuisance or trespass. Justin Bates KC is notable for his residential property expertise – he is instructed for the residents in Global 100 v Jimenez, a case due to be heard by the Court of Appeal, after a “property guardianship” company was found by the tribunal to have run an unlicensed house of multiple occupation, therefore subjected to local authority fines and rent repayment orders.

Types of work undertaken
Planning: Landmark remains at the forefront of UK planning with members advising on high-profile national and international issues regarding the built environment. Climate change, nuclear power, new coal-fired power stations with carbon capture storage, wind farms and other renewable energy schemes, airport expansion, iconic bridges and buildings, rail and road infrastructure, retail and leisure, housing and mixed-use schemes are dealt with on a daily basis.

Property: Landmark offers particular expertise in commercial and residential landlord and tenant, leasehold enfranchisement, boundary disputes, easements, restrictive covenants, mortgages, land registration, adverse possession and proprietary estoppel. The property team continues to be the first choice for solicitors instructed by clients wishing to injunct or remove squatters and protestors.

Public: Landmark’s barristers appear frequently in applications for judicial review and before a range of statutory tribunals and inquiries, as well as appeals, in the UK and beyond. Members cover the full range of public law cases including education, local government, social security, human rights, immigration, mental health, housing, prisons, and planning and environmental.

Environmental: Landmark’s barristers are experts in the environmental aspects of town and country planning and, with their strength in public law, they are the natural choice for environmental challenges in the higher courts. Its property barristers complete the package, with experience at all levels of advising on environmental issues in this area.

Rating and valuation: members have undertaken a wide range of valuation work. They apply that experience and expertise over a wide range of areas, including compensation by public authorities, rating valuations, rent reviews, tax valuations, leasehold enfranchisement and council tax valuations. Members have taken part in leading cases in the UK and overseas covering a diverse range of properties and businesses.

Leasehold enfranchisement: members offer genuinely specialist advice to solicitors, valuers and clients, helping at every stage, including advice, drafting, help with expert reports, and appearing in courts and tribunals. Barristers frequently advise on related professional negligence claims. Much of Chambers’ work concerns property in prime Central London where values are highest. Members regularly act for both landlords, including London Estates, and for lessees.

Europe and international: Landmark’s international work includes acting for both private litigants and government bodies, and spans all of its practice areas. Members have appeared regularly before the European Court of First Instance, European Court of Justice, European Court of Human Rights and the UNECE Aarhus Convention Compliance Committee for private parties and the UK government. Members have worked in a number of international jurisdictions including Hong Kong, Malaysia, Philippines, British Virgin Islands, Trinidad and Cambodia.

Mediation and arbitration: Landmark is committed to alternative dispute resolution. Its members include leaders in the fields of rent review arbitration and expert determination. A number of practitioners are also qualified as arbitrators and mediators, and are on the list of counsel to be appointed by the chairman of the Bar Council to act as independent experts.

Access to the Legal Profession

Landmark is keen to improve social mobility at, and access to, the legal profession and the Bar. It believes that by working towards a profession that is ‘representative of all and for all’; we can better serve our clients and our wider communities. To support this aim we are committed to a number of initiatives that seek to improve access to the profession and to assist in addressing some of the barriers that often stand in the way of developing a career as a barrister or in a supporting role in Chambers.

Opportunities for all

Mentoring scheme for aspiring planning and environmental barristers

Landmark Chambers firmly believes that widening access to the Bar can only serve to drive excellence by enabling us to draw on as wide a pool of talented aspiring barristers as possible.

Along with five other sets specialising in Planning, Property and Public Law, we have set up a mentoring scheme for underrepresented groups at the Bar. The scheme is supported by the Planning and Environmental Bar Association (PEBA) and is intended to encourage undergraduates and postgraduates from groups which are not well represented at the Bar, to consider becoming barristers. The scheme aims to provide advice and guidance to suitable candidates on the process of becoming a barrister.

PEBA and each of the partner Chambers recognises the importance of greater equality and diversity in the Bar. The hope is that this Mentoring Scheme will lay the foundations to creating a profession that is representative of all and for all, by introducing those from non-traditional backgrounds to the profession.

Bridging the Bar

Landmark offers additional mini-pupillages, over and above its usual quota, to Bridging the Bar, a charity which aims to increase diversity at the Bar by ensuring equal access to opportunity, through a structured mini-pupillage programme and mentoring scheme.

Bridging the Bar organises access to Landmark’s additional mini-pupillages so as to ensure the greatest possible level of access to those people from underrepresented groups.

10,000 Black Interns Programme

The 10,000 Black Interns programme is an initiative to transform the horizons and prospects of young Black people in the United Kingdom, by offering paid work experience across a wide range of industries. The aim is to provide training and development opportunities and to create a sustainable cycle of mentorship and sponsorship for the Black community.

Rare Contextual Recruitment System

Landmark utilises the Rare Contextual Recruitment System to inform our mini-pupillage and pupillage recruitment processes, as part of our commitment to being an inclusive Chambers.

Rare is a multi-award-winning diversity company which uses big data to map the social, financial and educational background of candidates, to ensure that brilliant candidates are identified and given the chance to flourish. The system works by combining publicly-available information with candidates’ anonymised responses gleaned as part of the application process. The result delivers two outputs: social mobility flags to measure disadvantage; and Performance Index (PI), to measure outperformance compared to students at the same school. This enables candidates’ academic results to be put into context, where possible, and in particular to factor in any socio-economic, personal or educational disadvantage to which a candidate may have been subject. This way of identifying candidates who have over-achieved in the light of their wider personal circumstances, or whose achievements should be seen in the light of specific challenges they have faced, should put them on a more equal footing against candidates who have not faced these obstacles.

Landmark Mini-Pupillage Scheme – Financial Support

Landmark Chambers believes that it is important to ensure that students from all backgrounds are able to undertake their mini-pupillage at minimal expense to themselves and, in doing so, improve social mobility at, and access to, the Bar.

Chambers therefore offers all mini-pupils a maximum reimbursement of £100 for reasonable travel and lunch expenses. Additionally, Landmark operates a discretionary accommodation funding scheme for students visiting from outside of London.

Women in Law Pledge

Landmark Chambers is making the Women in Law Pledge for three important reasons. First is the absolute belief that people of all genders are valued and that Landmark should be a place of equal opportunity for all barristers and staff. Second is that the Pledge will give us the opportunity to publicly share the work already being done to make Landmark a champion of promoting women in law. Third, the Pledge will formalise specific targets for Landmark to focus on over the next few years, increasing the chances of success in achieving them.

Landmark Chambers wants to attract the very best barristers and staff and to encourage and support professional development with a view to being a place where people want to stay. Women are underrepresented in law and Landmark is no exception. We want to attract more female barristers to join us and to stay and develop their careers. The Pledge targets for Landmark Chambers were chosen with these goals in mind. The more successful Landmark is at meeting the needs of its female barristers, the more attractive it will be to new applicants. As we move forward, we will regularly review the proportion of women entering Law and how Landmark compares locally and nationally.

TARGET 1: Five female members of Chambers to take Silk by 2025.

TARGET 2: Over the next five years (to 2025) there will be parity between the retention rates of female and male members of Chambers at Landmark.

TARGET 3: To employ at least two female clerks at Practice Manager level or above by 2025.

We are proud of and excited by our targets. Meeting them will require sustained dedication from all barristers and staff. We are motivated by the shared confidence in the knowledge that achieving our targets will enrich Landmark and the legal profession as a whole.
