Position

All aspects of the law governing financial relationships between family members, including the drafting and implementation of pre- and post-nuptial agreements (and their subsequent enforcement or avoidance), financial provision on relationship breakdown (upon divorce under the Matrimonial Causes Act 1973 (and/or dissolution under the analogous Civil Partnership Act) and Part III of the Matrimonial and Family Proceedings Act 1984, generally under TLATA 1996 and for children (pursuant to Schedule 1 of the Children Act 1989) and associated issues relating to jurisdiction, companies, family trusts, offshore trusts, taxation, other family wealth-holding structures and enforcement of orders and agreements. Cases include at first-instance DB v PB [2016] EWHC 3431 (fam), MB v EB [2019] EWHC 1649 & 3676, CA v DR (Schedule 1 Children Act 1989: Pension Claim); in the Court of Appeal, Prest [2015] EWCA Civ 714, Hart [2017] EWCA Civ 1306 & [2018] EWCA Civ 1053, Brack [2018] EWCA Civ 2862 and Goddard-Watts [2023] EWCA Civ 115; and, in the Supreme Court, the leading cases of Agbaje [2010] UKSC 13 (Financial Provision after overseas divorce pursuant to Part III MFPA 1984) and Sharland [2015] UKSC 60.  Peter has a particular interest and experience in cases involving non-disclosure (with which Sharland and Goddard-Watts were both concerned) and enforcement by way of committal/judgment summons (which were the subject of Prest and Hart).
