Roderick I’Anson Banks
Barrister heading up the only chambers specialising exclusively in partnership and LLP law, which he founded in 1991. Although he deals primarily with disputes and problems affecting solicitors’ and other professional firms and LLPs, he also regularly advises in other areas, e.g. hedge fund and farming partnerships. He has a long track record as a draftsman of all forms of bespoke partnership and LLP-related documentation and extensive experience in contentious matters involving expulsions and compulsory retirements, ‘lock-ins’ and ‘extractions’, firm-wide downsizing operations, dissolutions, Syers v. Syers applications, garden leave and restrictive covenant disputes. He has assisted numerous firms with the process of LLP conversion, including resolving pre-conversion disputes, and the drafting, review and updating of LLP agreements. At the same time, he continues to draft traditional partnership agreements, retirement and dissolution agreements and other documents in the more traditional partnership field. He is used to providing complex drafts at very short notice.
He is known for his hands-on approach to partnership disputes, yet advocates a subtle and, where possible, preventative approach in the embryonic stages, utilising mediation where appropriate. Advice can be given outside office hours and away from chambers, where confidentiality is at a premium. Most of his litigation work is conducted in arbitrations.
He acted as a consultant to the Law Commission in its review of Partnership and Limited Partnership Law (1999-2003).
