David H. Kistenbroker is co-leader of the white collar and securities litigation practice of Dechert LLP and managing partner of the firm’s Chicago office. He represents publicly traded companies and their directors and officers in securities class actions, SEC investigations, internal investigations and corporate governance disputes.

Dechert LLP’s New York team was joined in January 2017 by David Kelley from Cahill Gordon & Reindel LLP, who became practice co-chair alongside the Chicago-based David Kistenbroker. Other new arrivals include New York-based Benjamin Rosenberg, who joined from the Manhattan District Attorney’s Office, and Christina Guerola Sarchio in Washington DC, who joined from Orrick, Herrington & Sutcliffe LLP. The firm has particular expertise in securities-related matters; Andrew Levander represented the former senator, Jon Corzine, in investigations and litigation arising from MF Global’s bankruptcy, leading to a negotiated settlement with the Commodity Futures Trading Commission (CFTC). Jonathan Streeter is representing James Icahn in pending investigations by the Southern District of New York Attorney’s Office and the SEC into insider trading allegations. In another key mandate, the group is serving as Toyota’s independent monitor as part of a deferred prosecution pertaining to compliance and safety. The ‘sharp and practical’ Catherine Botticelli in Washington DC is also recommended.

Kistenbroker and Joni Jacobsen defended Swisher Hygiene and others against actions seeking injunctive and monetary relief after the sale of assets to Ecolab. The firm has ‘star power among its senior talent’, which includes firm chairman Andrew Levander, who last year argued an appeal for Rockstar Games. David Kistenbroker, who practices in both New York and Chicago, is global head of the securities litigation practice. With Joni Jacobsen in Chicago, he represented Asanko Gold in a 10b-5 class action in which plaintiffs alleged the company made false or misleading statements about mineral resource estimates. The same team secured the dismissal of a 10b-5 case for Anavex Life Sciences and former executives that centered on claims that they misled investors about the efficacy of an experimental Alzheimer’s drug to artificially inflate the price of its stock. Global litigation head Matthew Larrabee in New York and key partner Michael Kichline in Philadelphia are also recommended.
