Career

Douglas E. Fleming III focuses on complex litigation, specifically matters concerning mass torts, product liability, environmental toxic torts, and insurance. Mr. Fleming regularly represents clients from the chemical, pharmaceutical, medical device, consumer product, building materials and insurance industries. His clients have included numerous Fortune 500 companies located nationwide involved in mass tort litigation filed across multiple federal and state jurisdictions. 

Mr. Fleming has extensive experience litigating cases at both the trial and appellate levels throughout the United States, including examining and preparing fact and expert witnesses for deposition, trial and legislative testimony. In addition to arguing complex motions before courts across multiple jurisdictions, Mr. Fleming has also written briefs in the United States Supreme Court. 

As a former New York City Public Attorney, Mr. Fleming has participated in numerous pro bono matters, acting as a key lawyer in multiple trials relating to high-profile shootings. He has represented the City of New York, as well as indigent plaintiffs and non-profit organizations.

Highly regarded in the pharmaceutical space, Dechert LLP is particularly experienced in handling product liability, mass tort and class actions for manufacturers and distributors. Jointly led by New York-based Sheila Birnbaum and Mark Cheffo, the team is representing Purdue Pharma as national counsel in over 1,400 cases regarding its prescription opioid medication, and is defending Pfizer as lead national counsel in litigation relating to the antidepressant Zoloft, which allegedly causes birth defects in children when taken during pregnancy. The practice group also continues to represent AbbVie in national product liability litigation involving testosterone replacement therapy AndroGel, including an MDL in Chicago in which Nathan Hoffman takes the co-trial counsel role. Moreover, the team is acting as lead appellate counsel for Johnson & Johnson in the mass tort litigation claiming personal injury from use of anti-psychotic medication Risperdal. Philadelphia-based Ben Barnett and Douglas Fleming in New York are other key members of the practice group.

  • Bär & Karrer Advised Cembra Money Bank on the Financing of the Acquisition of cashgate

    Cembra Money Bank has agreed to acquire cashgate. The purchase price for the acquisition of cashgate and the refinancing of cashgate's loan portfolio is partly backed by a bridge facility and is financed and refinanced by the sale of treasury shares (gross proceeds of CHF 112.8 million) in an accelerated bookbuilding, the placement of CHF 150 million perpetual additional Tier 1 bonds and CHF 250 million net share settled convertible bonds.
  • Bär & Karrer Successfully Represents PNK Group Company in SCAI-Arbitration

    Bär & Karrer successfully represented a company acting under the trademark of PNK Group, a major developer of industrial facilities in Russia, against a Western European concrete plant engineering and manufacturing company in a SCAI-arbitration concerning the delivery of (defective) equipment. After full-fledged proceedings including a hearing with several technical experts, the client was awarded partial rescission of the contract (as requested) with returning of certain defective equipment against refund of its cost, a substantial price reduction with regard to the rest of the equipment, as well as a contractual penalty payment and reimbursement for 75% of all legal costs. Team members were Matthew Reiter and Désirée Schreyer (both arbitration).
