Environmental Transactional and Risk Management

Special Counsel

John M. Ix counsels clients on environmental regulatory compliance issues, supports litigated environmental disputes, and negotiates environmental terms in business transactions. He formerly served as co-chair of the Philadelphia Bar Association’s Environmental Law Committee.

Prior to attending law school, Mr. Ix worked as a geologist for an environmental consulting firm. That experience, coupled with his undergraduate and graduate science degrees, provides him with a distinctive understanding of the technical issues underlying environmental compliance, litigation, and transactional matters.

Mr. Ix has counseled clients on compliance with federal and state environmental laws, specifically assisting them in developing cost-effective solutions to site remediation and permitting issues. Mr. Ix has also represented clients in litigated and mediated environmental matters, including environmental disputes between successive property owners, neighboring property owners, landlords, and tenants. He also has assisted clients with environmental issues arising out of real property transfers and other business transactions, including negotiating environmental provisions of asset and stock purchase agreements, securitization agreements, and access agreements, and evaluating the sufficiency of environmental risk mitigants such as environmental insurance.

Based in Philadelphia, Dechert LLP‘s practice routinely advises on the environmental implications of acquisitions and divestitures in the real estate and corporate spaces, and is also fairly active in real estate financing deals at the domestic and international levels. Working in close collaboration with the firm’s 26 offices around the globe, the team receives instructions involving the negotiation of environmental provisions in the structuring of transactions, environmental due diligence and development of mechanisms to mitigate environmental risks, including indemnities and reps and warranties policies. In addition to assessing the environmental liabilities associated with corporate, real estate and financing deals, department leader Abbi Cohen is also recommended for federal permitting and regulatory compliance advice. The latter is an area of focus for John Ix, who is also seasoned in environmental disputes.
