Career

Monserrat heads the Firm's Intellectual Property and Technology team in the Costa Rica office. 

She helps clients develop consistent IP strategies involving copyright, trademarks and patents, trough effective protection and commercialization schemes. She also works with them to safeguard their information, by designing global compliance programs for data privacy, implementing cybersecurity policies, and strengthening vendor and third party agreements.

In addition to providing practical counseling to established companies, from a broad spectrum of industries like software, life sciences, telecommunications, media, shared services, and retail, Monserrat is very involved in the startup scene, helping foster new technology companies and providing advise that helps them succeed.

She began her career in Argentina where she managed compliance and enforcement campaigns for some of the world´s most important software producers and trade associations. In 2011, she joined BSA| The Software Alliance in Washington, DC, first as Legal Counsel for the Latin America program to oversee legal firms throughout the region, and later in 2014, as part of BSA’s global compliance team where her responsibilities included copyright license analysis, contract revision and negotiation in Brazil, Mexico, India, Thailand, Poland, and Russia.

 Monserrat has taught university courses on topics involving IT-related laws.

Dentons Muñoz’ IP practice is led by senior associate Monserrat Guitart and handles patent and trade mark strategy-development and registration, as well as contentious IP and data privacy matters. Recent work saw the team advise a tequila producer on its trade mark strategy as part of its entry into Central American markets, as well as the registration of a 3D trade mark. Other work includes the successful defence of a corn flour and products manufacturer against a trade mark opposition filed by direct competitors. Another key feature of the practice is its expertise in plant variety registration, as evidenced by its recent advice to a pineapple merchandising and developing company on related matters. Litigation practice head Roy Herrera, who is frequently involved in contentious IP matters, also deserves mention.
