Partner and head of the Construction and Engineering team. Gary has significant experience of advising on contentious construction & engineering disputes including professional negligence claims, through adjudication, mediation and litigation.    Considerable experience of litigation at all levels of the civil courts, in particular, the High Court, Technology and Construction Court division.  As a specialist practitioner of construction adjudication, Gary has personally acted in over 80 individual adjudications with a proven track record of success.  Gary has particular expertise in the enforcement of adjudicator’s decisions with several, high-profile reported cases including Caledonian Modular Ltd -v- Mar City Developments Ltd [2015] EWHC 1855 (TCC) and Enviroflow Management Ltd -v- Redhill Works (Nottingham) Ltd [2017] EWHC 2159 (TCC).

Schofield Sweeney’s ‘commercially excellent’ team saw substantial growth recently following the recruitment of tax litigator Leo Jones-Rowe from LCF Law, financial services specialist Matthew Fidler from Stewarts Law LLP, and construction litigator Gary Ashton from Hawkswell Kilvington Limited. They join team co-heads James Staton and Alistair Kennedy; Staton is ‘incredibly professional’ and Kennedy is ‘a go-to litigator who is someone you definitely want fighting your corner’. Kennedy’s recent work includes defending an Isle of Man trustee company in litigation relating to sale proceeds from the public listing of a company on AIM, and acting for Menston Action Group in judicial review proceedings regarding a proposed Barratt Homes development including sustainable drainage issues. Other work includes Staton defending three former company directors in a dispute brought by a former director regarding allegations of conspiracy and collusion and breaches of directors’ duties; and Fidler defending a Guernsey property company in a banking claim arising out of a group restructuring and corporate sale. Closegate Hotel Group, A Share Greener and Bebe Clothing are also clients.

The 'exceptional' professional negligence department at Schofield Sweeney, headed up by Richard Stockdale, is known for its representation of high net worth individuals and SMEs in claims against solicitors, counsel, financial and tax advisers and construction professionals. Alistair Kennedy, who is singled out for his 'sound, practical advice', acted for an individual in a £4m claim arising from auditing, and other accountancy errors, which contributed to the collapse of a car sales business. The Leeds-based practice has been bolstered with the arrivals of Leo Jones-Rowe, Matthew Fidler and Gary Ashton from LCF LawStewarts Law LLP and Hawkswell Kilvington Limited, respectively.
