Position

Alistair has dealt with many high value claims in the High Court and Appeal Courts, including several cases that have been reported and/or attracted significant press attention. Alistair has particular experience of claims against major banks for companies and individuals. He has also dealt with many complex professional negligence claims (notably in relation to unsatisfactory investment, tax or legal advice), and commercial fraud and bribery disputes. Alistair has specialist experience of Public Law and has dealt with Judicial Review proceedings against government and other public bodies on a range of issues.

Alistair joined Schofield Sweeney in 2013 having spent 4 years at Stewarts Law and having trained and spent 6 years Walker Morris.

Schofield Sweeney‚Äôs ‚Äėcommercially excellent‚Äô team saw substantial growth recently following the recruitment of tax litigator Leo Jones-Rowe¬†from LCF Law, financial services specialist Matthew Fidler¬†from Stewarts Law LLP, and construction litigator Gary Ashton¬†from Hawkswell Kilvington Limited. They join team co-heads James Staton¬†and Alistair Kennedy; Staton is ‚Äėincredibly professional‚Äô and Kennedy is ‚Äėa go-to litigator who is someone you definitely want fighting your corner‚Äô. Kennedy‚Äôs recent work includes defending an Isle of Man trustee company in litigation relating to sale proceeds from the public listing of a company on AIM, and acting for Menston Action Group in judicial review proceedings regarding a proposed Barratt Homes development including sustainable drainage issues. Other work includes Staton defending three former company directors in a dispute brought by a former director regarding allegations of conspiracy and collusion and breaches of directors‚Äô duties; and Fidler defending a Guernsey property company in a banking claim arising out of a group restructuring and corporate sale. Closegate Hotel Group, A Share Greener and Bebe Clothing are also clients.

The 'exceptional' professional negligence department at Schofield Sweeney, headed up by Richard Stockdale, is known for its representation of high net worth individuals and SMEs in claims against solicitors, counsel, financial and tax advisers and construction professionals. Alistair Kennedy, who is singled out for his 'sound, practical advice', acted for an individual in a £4m claim arising from auditing, and other accountancy errors, which contributed to the collapse of a car sales business. The Leeds-based practice has been bolstered with the arrivals of Leo Jones-Rowe, Matthew Fidler and Gary Ashton from LCF Law, Stewarts Law LLP and Hawkswell Kilvington Limited, respectively.

  • THE VAT E-COMMERCE PACKAGE

    A. INTRODUCTION   The VAT E-commerce Package adopted by the Council on the 5th of December 2017 includes several changes that will be gradually implemented, some changes will be effective as from the 1st of January 2019 and the rest as from the 1st of January 2021.
  • Doing business in Ukraine: turning point for the currency control in Ukraine

    One of the most hotly discussed topics in 2019 is currency control liberalization in Ukraine.The currency control liberalization was one of Ukraine‚Äôs priorities under the EU-Ukraine Association Agreement. At the beginning of 2019 the National Bank of Ukraine (hereinafter the ‚ÄúNBU‚ÄĚ) approved and promulgated all long-awaited regulations, serving as the basis for a new liberal¬†system of foreign currency control. The new¬†currency control¬†system will be launched on 7 February 2019, the same day as the Law of Ukraine¬† On Currency and Exchange Transactions¬† becomes applicable. The changes are aimed at deregulation, facilitating cross-border transactions with foreign currency and expanding the list of available foreign currency transactions.
  • New Long Term Residency Visas

    After much media coverage, Cabinet Decision 56 of 2018 (the Decision ) has been gazetted which introduces new long term residency visas to, amongst others, four categories of persons in the UAE. 
  • Significant Changes to Civil Procedure Code

    Significant changes to Federal Law No 11 of 1992 (the Civil Procedure Code ) will soon be coming into effect. These changes are introduced through regulations (the Regulations ) issued under the Civil Procedure Code and will come into effect on 16 February 2019.
  • Merger Clearance Matters

    The United Arab Emirates (the UAE ) promulgated legislation to specifically address the regulation of competition (being Federal Law 4 of 2012, or the Competition Law ) several years ago but until recently, it has been the case that the requisite implementing regulations and processes were not in place. This is no longer the case. Not only have the much anticipated implementing regulations been issued, the UAE Ministry of Economy (the Ministry ) (being the regulator in charge of administering the UAE competition regime) has now formed the required committee and issued the anticipated guidance and forms to allow concerned parties to make merger clearance submissions to the Ministry where required to do so pursuant to the Competition Law.
