Partner: Janine is a commercial disputes lawyer and primarily acts for investors, borrowers and private equity houses typically in disputes against the major retail banks as Janine and the Banking and Financial Disputes team at the firm are "Conflict Free". She has substantial experience of disputes involving interest rate, currency and credit derivatives, the misselling of investments, LIBOR fixing and other benchmark manipulation and complex property and development finance, including syndicated lending and disputes arising from the work out and trading of distressed debt and investment in litigation funding. Janine's work also encompasses construction disputes, insurance disputes, professional negligence claims and judicial review of public authority and regulatory decisions, particularly relating to the FCA. Equally comfortable in both litigation and arbitration, Janine's practice often features multi-jurisdictional disputes involving conflict of law issues. For such matters, Janine works closely with lawyers in other jurisdictions to ensure a co-ordinated approach and optimal outcome. Janine has particular expertise in applying for and resisting interim remedies including injunctions, security for costs, search orders and freezing orders. Janine's approach is a commercial one, providing robust representation and advice and taking into account both legal and commercial factors to work with clients to achieve the best possible outcome at proportionate cost. Janine is a keen advocate of alternative dispute resolution, in particular mediation.

Collyer Bristow LLP is best known for conflict-free litigation against banks;and disputes regarding complex products and financial structures including derivatives, benchmark manipulation, assignment of bank debts, and distressed debt trading, along with syndicated lending, securitisation, and unregulated collective investment schemes. It acted for Secure Capital (SC), a Luxembourg investment vehicle, in Commercial Court proceedings against Credit Suisse, which had issued longevity notes; SC alleged that the notes were designed to fail. Other areas of strength include trusts claims, contentious insolvency and cross-border claims. Stephen Rosen led advice to Equatorial Congo Airlines (ECA) in a dispute with PrivatAir, a Swiss company that formerly operated ECA's fleet of aircraft; the dispute included seizure of a number of ECA's aircraft in Brussels for alleged breaches of contract and disputes over maintenance contracts, costs of repairs and other operating expenses. Jeff Roberts is 'responsive, effective and a pleasure to work with'; and Richard Viegas was recently appointed head of commercial disputes.
