Clyde & Co LLP

Simon is the firm's Senior Partner and chairs the Clyde & Co Global Management Board, working with regional boards in MEA, APAC, the Americas, and the UK and Europe. He also maintains a legal practice focusing on commercial dispute resolution and professional liability and previously headed up the firm's insurance practice.

  • We acted for the world's largest property services firm, in relation to a claim regarding the alleged overvaluation of a large portfolio of commercial properties. The claim involved novel legal issues regarding the application of the margin of error applied in valuation claims where the claim relates to a valuation of multiple properties. It also involved difficult issues regarding the recoverability of losses attributable to an interest rate swap agreement, and the impact of the securitisation on the claimant's ability to recover damages.
  • This claim focussed on allegations of insolvency practitioner negligence arising out of a "pre-pack" in particular that our clients undervalued a base metals mine and could have sold it for significant sums unencumbered. The team's role throughout this matter was to devise a strategy which carefully navigated a way through thes issues, whilst balancing the insurers'/insured's respective interests. This claim ultimately proceeded to trial and resulted in a settlement on day 10. Aside from varied and complex substantive issues, we required to work with a large market of six experienced insurers, each of whom held their own distinct view on strategy and approach.

Prior to the merger with Clyde & Co in 2011, Simon was the Senior Partner at Barlow Lyde & Gilbert LLP.

He is legal advisor to the RICS Market Liaison Group and has amassed extensive experience of multi-jurisdictional commercial insurance and professional liability disputes.
