Position

Richard Harrison heads Clyde & Co's Lawyers’ Liability Group. He specialises in all areas of claims against English solicitors and barristers. He has more than 25 years' experience in claims arising out of every area of lawyers' commercial practice, including all aspects of dishonesty/fraud. He also specialises in associated policy/coverage issues and risk management as well as advising in relation to regulatory and disciplinary matters. Richard has regularly taken cases to final hearings in all of the divisions of the High Court, Court of Appeal and House of Lords/Supreme Court and has considerable experience representing clients as their advocate at mediation.

Experiences:

  • Acted on behalf of a law firm in relation to the Defence of a number of claims brought against the firm in the London High Court. The claims against include: claims for conspiracy fraud; breach of undertaking; negligence; and breach of trust.
  • We acted for a law firm in defence of a Claim in the Commercial Court brought by a German public body. The Claim related to a legal opinion provided in connection with a complex financial derivatives transaction between an investment bank and the German public body. This case demonstrates Clyde & Co's capability to deal with professional liability disputes of the most complex kind and our capacity to manage cross-border disputes governed by foreign law which are heard in English court proceedings.

The practice's expertise covers a number of sectors, including medical and healthcare, legal, accountancy, property, insurance and financial services.  The team defended a leading agricultural law solicitor (PW) in the Solicitors Disciplinary Tribunal (SDT), followed by a successful appeal in the Administrative Court, which overturned an SDT order striking PW off the roll. The department heads are Claire Petts, who regularly defends health professionals. including doctors, dentists and opticians, in disciplinary proceedings; and the 'extremely easy to work with and incredibly responsive' Fergal Cathie, who has a particular focus on complex disputes and regulatory investigations involving professionals, particularly in the legal and financial services sectors. Richard Harrison heads the firm’s lawyers’ liability group, Sarah Clover chairs the executive of the firm's UK professional and financial disputes team, and James Roberts heads the firm's accountants' liability and disciplinary group. Sam Holden  is a highly regarded legal director and Tim Crockford and consultant Judith Duffin  were hired from Gowling WLG and BLM, respectively.
