Position

Jane Andrewartha, Litigation and Arbitration Partner of Clyde & Co, is best known as an insurance and reinsurance practitioner who has served the London and international insurance markets for over 40 years. She handles litigation before the High Court in London and courts internationally and Arbitration in all its forms involving LCIA, ICC, AAA, UNCITRAL, the LMAA and other rules and/or institutions. She sits as Arbitrator herself and has acted as Early Neutral Evaluator. She also acts as settlement counsel in intractable disputes/litigation although not, in such circumstances, as a neutral. Her reputation is in handling complex, high value disputes requiring careful strategic and tactical planning, whatever the jurisdiction or forum. Above all she is known for seeking early resolution of difficult disputes thus limiting the legal expense but, in those cases in which settlement is not possible, her reputation is for her tough approach to litigious matters, her thorough case analysis and detailed preparation leading to many successful judgments/awards. Recent cases include a US$500m Commercial Court action settled on wholly favourable terms shortly before trial and a successful reinsurance arbitration in which the full claim, interest and costs were recovered.

She has also been involved in Alternative Dispute Resolution, primarily mediation, since 1995 when appointed as advocate in one of the earliest major mediations to take place in the insurance sector in England. Trained by CEDR and accredited as a mediator in 1996 Jane has been involved in approximately 800 mediations, covering a wide range of commercial disputes, frequently of a complex, international and multi-party nature. In addition to numerous insurance and reinsurance cases Jane has mediated disputes involving aviation, banking and finance, business contracts, construction and property disputes, commodities, employment, trusts, lender liability, marine and energy sectors, professional liability, partnership/joint ventures, and others.

Jane is also the non-executive Chairman of a London insurance company and a Trustee of the University of London. She sat on the first Clyde & Co Management Board, appointed as the Finance Partner; she has served as Clyde & Co's Head of Latin America (establishing the firm's first office there) and as Head of Aviation. She formerly sat on the Board of CEDR, the dispute resolution body.

With almost 200 partners across the UK involved in insurance work, a team that continues to recruit, and a client list that includes almost every leading (re)insurer globally - the likes of AIG, Allianz, Aviva, Swiss Re and Zurich - Clyde & Co LLP has earned its reputation as ‘a juggernaut for insurance matters’.
