Insurance: advice to insurers Tier 1

With eight offices along both coastlines and one in Chicago, Clyde & Co LLP's US practice advises on the full gamut of claims and disputes, as well as sector-related corporate, commercial and employment work. Apart from general liability, financial, property and D&O disputes, the department also specializes in accident and health, fine art, cyber, energy, aviation and maritime insurance matters. New York partner Paul Koepff has been serving as co-trial and co-coverage counsel for four insurers in a high-profile dispute with disgraced film producer Harvey Weinstein over his entitlement to defense and indemnity following the multiple allegations of sexual misconduct made against him. New York managing partner Michael Knoerzer is advising the London Market in a D&O policy dispute related to criminal claims brought by US prosecutors against multiple high-level football officials. In New Jersey, Darren McNally acted for Aetna Insurance Company and Insurance Company of North America in an insurance policy dispute against The National Collegiate Athletic Association, which faces claims concerning concussion-related injuries. Chicago-based Eileen King Bower  is acting for XL Insurance America against Eli Lilly and its Brazilian subsidiary in a dispute regarding an underlying environmental contamination claim.

Transport: aviation and air travel - litigation Tier 2

Clyde & Co LLP has experience with product liability disputes in the aviation sector, but is perhaps best known for its experience in defending airlines and insurers in aviation mass disasters. The team benefits from an international network of lawyers and regularly handles cross-border cases. Aviation group head Andrew Harakas in New York has ‘a level of experience that makes clients feel very secure when facing any type of litigation’; he represented Etihad Airways in a personal damages claim involving a passenger stuck by a needle in the seat pocket during an international flight. New York-based Jeffrey Ellis is representing United Airlines in litigation arising from the 9/11 terrorist attacks, and also represented Consumer Technology Association and AUVSI in the first case in the US addressing the right of states and municipalities to regulate, restrict and/or prohibit drone use. Elsewhere, Christopher Carlsen in New York represented AVCO Corporation in a design defect product liability law suit. Other key figures include Miami-based Thompson Thornton, Los Angeles-based senior associate Natasha Mikha and Kevin Sutherland, who is based across the firm’s Los Angeles and San Francisco offices.

Transport: shipping - litigation Tier 2

The ‘super knowledgeable’ team at Clyde & Co LLP is commended for its ability to handle cross-border disputes for domestic and international shipping companies, commodities trading firms and their insurers. Also of note it the team's ‘knowledge of the London market, which is second-to-none’. The practice group handles an array of shipping disputes involving liability, cargo, pollution, sanctions, insolvency, war risk, loss of earnings and environmental claims. In New York, John Keough advised Diamond S Management and its P&I Club in successfully releasing the M/V Atlantic Lily from arrest, and also handled related charterparty disputes and US sanctions issues. Also in New York, John Woods advised various London underwriters on alleged losses by theft in warehouses and tank farms in Germany, China and Morocco. Woods also defended Water Quality Insurance Syndicate (WQIS) in a high-profile claim brought by the excess liability insurers, regarding a collision which occurred in the lower Mississippi River between a tanker and a fully loaded oil barge in 2008. Conte Cicala in San Francisco and senior counsel Corey Greenwald in New York are also key figures. Joseph Walsh joined Collier Walsh LLP in 2018.

Latin America: International firms > City focus: Miami

Clyde & Co LLP has a sizeable Miami office that is increasingly connected to Latin America business. Dual qualified English and Brazilian partner Ricardo Lewandowski  splits his time between London, Miami and Sao Paulo and focuses primarily on international arbitration and cross-border litigation involving Latin America and Africa; these include construction, engineering, energy, mining, and insurance and reinsurance disputes. Caracas partner Aurelio Fernandez-Concheso spends a considerable amount of time in Miami working on transactions for US businesses, Latin America corporates and wealthy individuals.
