Joshua Fitzhugh’s practice focuses on export control and international sanctions law, anticorruption compliance, international trade regulation, customs law issues, global trade agreements and national security law.

Josh is a highly experienced trade control, anti-corruption and international trade lawyer with nearly two decades of experience in private practice, in-house executive and government positions.

Prior to joining Clifford Chance, he served as Vice President and Group Head of Trade Controls for one of the world’s largest defense contractors – BAE Systems plc in London. In that role, he was responsible for managing global trade controls, including export controls, sanctions and trade compliance for all BAE Systems divisions not subject to a U.S. special security agreement.

Josh led BAE’s response to a 2011 consent agreement with the U.S. Department of State, including managing the group’s legal obligations and improvement program; directing export control and sanctions investigations, compliance and licensing; enhancing export control and related policies, procedures and processes; managing the group’s exposure to trade control risk; establishing and leading the trade control function; and managing compliance relationships with government regulators, industry and other external and internal stakeholders.

For more than three years, Josh acted as Internal Special Compliance Official for the BAE Systems plc-managed entities, monitoring and reporting to the State Department on the group's progress under the consent agreement. In this capacity he engaged with most key US trade control officials in both the Obama and Trump Administrations, as well as many of their permanent staff.

Prior to his six year at BAE Systems, Josh worked for nearly a decade at Pillsbury Winthrop Shaw Pittman, where he was a Counsel in that firm’s International Trade Group. While there, his practice concentrated on export control, national security, sanctions, international anti-corruption and trade laws.

Josh previously worked in the U.S. Department of Commerce's International Trade Administration and the U.S. Department of State's Office of the Legal Adviser.

Josh has represented a range of US and non-US clients in compliance and enforcement matters before the US Department of State, US Department of Commerce and US Department of Treasury, and in litigation at the federal district, appellate and US Supreme Court levels.

Benefiting from a 'unique global coverage', Clifford Chance's Washington DC-based team provides 'reliable and accurate advice' to an impressive roster of banks and international corporates on economic sanctions and export controls compliance and enforcement matters. The 'superb' George Kleinfeld is 'able to draw upon vast experience of dealing with regulators and different client types' and has an 'excellent knowledge across OFAC and DOC regulations and sanctions'. Kleinfeld also handles CFIUS work, including his recent involvement, alongside lawyers from Germany and London, on the clearance necessary for Cinven, on the $2.6bn sale of Germany-based CeramTec to an investor consortium led by BC Partners. Lead US partner for the firm's global risk team, litigator David DiBari and Wendy Wysong, who splits her time between Hong Kong and Washington DC, have been advising Chinese telecoms company ZTE in a US investigation of unauthorized exports of US-origin telecoms equipment to Iran and other embargoed countries. 'Superb' counsel Jacqueline Landells also regularly provides 'able support' to Kleinfeld on OFAC matters, and Joshua Fitzhugh, who was formerly an in-house lawyer at BAE Systems, has an 'excellent understanding of the aerospace industry' and its international trade implications.

  • CommuniquĂ© on Equity Crowdfunding Is Officially Published

    By way of background, in January 2019, the Capital Markets Board (“ CMB ”) had issued an announcement on its website on the Draft CommuniquĂ© on Equity Crowdfunding [1] . The CMB has now officially published the CommuniquĂ© on Crowdfunding No. III-35/A (“ CommuniquĂ© ”), on October 3, 2019. The CommuniquĂ© entered into force as of October 3, 2019.

    The recent interpretative letter issued by the Russian Federal Tax Services (“FTS”) on 08th August 2019, has provided further guidance as to the application of the Beneficial Ownership Concept, further to the letter initially provided on the 12th of April 2018 which adopted a strict approach of the concept.

    Cyprus has concluded the negotiations for the avoidance of double taxation with the Netherlands. The double tax treaty was agreed at technocratic level in Hague. It is expected to be signed by the end of 2019 or early in 2020.

  • Court of Justice rules on source of income for Derivative Residence applications

    On 2 October 2019, the Court of Justice delivered its judgment in Bajratari v Secretary of State for the Home Department (Directive 2004/38/EC) Case C-93/18 which concerns Chen applications and the source of funds for self-sufficiency. 
  • End of the ‘centre of life test’ in Surinder Singh cases?

    In the recent case of  ZA (Reg 9. EEA Regs; abuse of rights) Afghanistan   [2019] UKUT 281 (IAC ), the Upper Tribunal found that there is no basis in EU law for the centre of life test, as set out in Regulation 9(3)(a) of the Immigration (European Economic Area) Regulations 2016 (the “Regulations”). It further found that it is not to be applied when Judges assess  Surinder Singh  cases that appear before them.
