Insolvency and restructuring.

Position

Toby McMurray is head of insolvency and restructuring at Tughans. Toby’s experience in the area of insolvency is extensive. He advises insolvency practitioners, financial institutions, businesses, directors and creditors on all issues relating to both corporate and personal insolvency. Most recently he has been instructed in some of Northern Ireland’s largest insolvencies including the Lough Erne Resort in Fermanagh, Obel Tower, and Botanic Inns Limited. Toby also led the firm’s successful challenge to the Northern Ireland bankruptcy order obtained by Sean Quinn, which is the leading authority on COMI in Northern Ireland and the cross-border freezing injunctions which were obtained by the firm in relation to Russian and Ukrainian assets in December 2011. The firm has continued to act for the Irish Bank Resolution Corporate (IBRC) in all of its Northern Ireland based Quinn litigation. His clients include: PwC, KPMG, Deloitte, BDO, Lloyds/Certus, NAMA, RBS/Ulster Bank, Bank of Ireland and AIB Group/First Trust Bank. In addition, Toby has a breadth of experience in commercial disputes. He has particular expertise in shareholder disputes, breach of directors’ fiduciary duty claims, Section 994 Companies Act petitions, share sale warranty claims and civil fraud claims.
