Key cases international Arbitration
Lead Counsels in ICSID Arbitration Case No ARB/07/6 (Tza Yap Shum v Republic of Peru) Claim filed by a Chinese investor. Under the Peru – China BIT, an ICSID tribunal awarded compensation for claimant after declaring as expropriation a number of measures taken by the Peruvian tax authority (SUNAT) that affected the viability of claimant’s business.
Lead Counsels in ICSID Arbitration Case No ARB/10/17 (Renee Levy v Republic of Peru) Claim filed by a French investor for the intervention and liquidation of her bank in Peru taken by the banking regulator and other State agencies pursuant to the Agreement between the Government of the Republic of Peru and the Republic of France on the Reciprocal Promotion and Protection of Investments.
Lead Counsel in ICSID Arbitration Case No ARB/11/17 (Renee Levy and Gremcitel v Republic of Peru) Second claim filed by a French investor for the frustration of a Real Estate development project that was declared an intangible area by the National Institute of Culture in violation of the Agreement between the Government of the Republic of Peru and the Government of the Republic of France on the Reciprocal Protection of Investments.
Special Local Counsel in UNCITRAL case, London v Republic of Peru Claim filed by an American investor for the discriminatory freezing of its industrial activities in the mining industry, pursuant to the Investment Chapter of the Free Trade Agreement between Republic of Peru and United States of America.
