Dispute resolution > Arbitration Tier 1

'The most recognised firm for international arbitration and public law' according to peers, Zuleta Abogados Asociados S.A.S  is one of the most prestigious and specialist arbitral offerings not just in Colombia but regionally. Client highlight the multidisciplinary five-partner, 19-strong team for its 'sophistication', 'cohesion and professionalism', 'excellent communication and ever-present sense of urgency'. Its impressive track record demonstrates unequalled strength in international arbitration, (both investment and commercial cases), under all the most common sets of arbitral rules (ICSID, ICC, ICDR, LCIA, etc.), and the firm has also developed a specialization in international public law (and increasingly, human rights) that is unique in the local market. Founding partner and practice head Eduardo Zuleta ('outstanding', 'spectacular', 'a fantastic lawyer and arbitrator') is a point of reference in the sector - a listed arbitrator for ICSID and the ICDR, not to mention local Chambers of Commerce in Bogota, Quito and Lima among others. In a key highlight, Zuleta teamed up with fellow co-head Rafael Rincón (noted for his 'attention to detail', risk anticipation and practical problem solving), to counsel Oleoducto Bicentenario de Colombia in three multimillion-dollar national and international arbitrations arising from transport contracts and a joint-investment agreement; recently -November 2020- obtaining a favourable settlement (pending Colombian regulatory, Comptroller General's Office and the local Cundinamarca administrative tribunal's approval). Additional bench-depth - and sectorial breadth - is provided by 30-year oil-and-gas veteran Gustavo Suárez, who acts as both arbitrator and expert witness on hydrocarbons' matters; the 'outstanding' Rafael Bernal, a former president, vice-president and deputy director of the Inter-America Commercial Arbitration Commission who has over a 40 years' experience in domestic and international arbitral matters; and former justice of Colombia's Council of State and Constitutional Court, Antonio Aljure, an expert in both public and private international law. Key associate support comes from Juan Ignacio Guerra, Sebastián Briceño, Maria Camila Rincón and Santiago Zuleta. However, Daniela Páez Cala left for Baker McKenzie S.A.S. in May 2021.  Having already brought in Luis Guillermo Rosero from Garrigues in January, the firm has since hired Rodrigo Sánchez Pineda, who arrived from Arrieta Mantilla & Asociados in July 2021.

Dispute resolution > Litigation Tier 2

While the vast majority of its work is in arbitral forums, Zuleta Abogados Asociados S.A.S also has unquestionable litigation capacity, perhaps best reflected recently by its successful representation of Uber, which permitted the company to maintain its operations in Colombia. The team handles commercial litigation, complex administrative litigation and class action cases, along with parallel litigation generated by its arbitral caseload. Additionally, the firm has developed international public and private law, and human rights, practices, to produce a sophisticated service offering that is both novel and unique in the local market. The firm houses a 19-strong disputes practice group (including five partners) and is led by the ‘spectacularEduardo Zuleta, whose career and practice has repeatedly set the bar -and pushed the boundaries- of dispute resolution in Colombia. Practice co-head Gustavo Suárez is an expert in the oil and gas sector (in which the firm has particular industry expertise), with over 35 years’ experience as counsel before ordinary and administrative courts, and arbitral tribunals. Fellow co-head Rafael Rincón Ordóñez has some 15 years’ experience in contentious matters including international litigation, notably in disputes related to construction, oil and gas. Another deeply-experienced figure, Rafael Bernal Gutiérrez brings expertise in commercial litigation (among his other capabilities), while Antonio Aljure Salame is deeply experienced in international law.

Testimonials

Active participation in all kinds of meetings. They remain attentive and only issue positions after having consulted with the technical area to be able to give concepts and positions based on technical and legal support.

Their attention is quick and efficient, which makes them stand out in a market as competitive as the legal one in large projects. Miguel Castro especially, is a lawyer who always seeks, from well-argued and solid positions, a consensus between the parties. Thanks to the excellent work they carry out, we count on the firm practically exclusively.

Zuleta Abogados has extensive knowledge about the structuring and negotiation of projects, as well as the resolution of disputes in this sector. Likewise, they care about knowing the business and proposing useful, viable and simple solutions. They have a great team of associates, who make teamwork possible.

I would highlight Rafael Rincón, a partner of the firm. Always present, unconditional support in transactions and with a vast knowledge of law and business, which allows us to obtain comprehensive solutions.

Extensive knowledge in structuring projects.

It is a team that is characterised by seeing options and alternatives for solving problems posed.

Miguel Castro has great knowledge in business structuring, especially knowledge of the National Infrastructure Agency, allowing him to manoeuvre strategically in the challenges presented.

The knowledge of the infrastructure sector in Colombia at Zuleta lawyers is enviable, they have a strong relationship with state entities, therefore they present strategies that fit perfectly.

Here I must speak directly of Dr Miguel Castro: first of all, he is a sensitive person, with passion for his work and totally trustworthy. With the work of the team that he leads, we feel calm, because he always gives us a clear risk analysis so as to make each decision.

The novelty lies in the fact that the lawyers on the Zuleta team have the sensitivity of people who put themselves in the client’s shoes and from that point of view propose alternative solutions.
